Dear Administrative Judges:

Enclosed is University's list of persons who will have a need for access to protected information as requested in the Board's Memorandum and Order of January 18, 1984.

University has not as yet had an opportunity to pursue discovery to determine the specific factual allegations to be made by CBG's qualified witnesses. As a result, University cannot at this time fully anticipate its need for expert witnesses and/or advisors.

University does anticipate that Mr. Charles E. Ashbaugh, Mr. Neill C. Ostrander and Dr. Walter F. Wegst will provide testimony on some aspect of UCLA's security system or the potential for sabotage in response to CBG's factual assertions.

Professional qualifica-tion statements for these witnesses are included here to supplement information already in the record.

University is concerned that the " exception clause" of the Protective Order (Paragraph 1.(b)) adopted by the Board may not clearly define the rights and obligations of the parties.

In accordance with the Board's request on page 5 of its Order that it be promptly notified of any need for additional 8401310348 840125 gDRADOCK 05000142 PDR G

John H. Frye, III, et al January 25, 1984 Page 2 exception, University requests that the following new paragraph "10" be added to the Board's Order:

"10.

Nothing in this Protective Order shall be deemed to deny access by or limit communications between officers, employees, consultants or contractors of the University of California and any other person or agency acting with a security purpose to information concerning such security, including any assessments of the adequacy of University's security or to information necessary for the taking of any action related to the security of University's facilities, notwithstanding that such information is not maintained in the normal course of business and whether or not the exchange of information occurs between solely authorized persons as defined in this Protecti've Order."

The recommended new paragraph will clarify that the University is not to be hindered in carrying out its ongoing security responsibilities, including security planning for the 1984 Olympic Games.

l The new paragraph somewhat duplicates the " exception clause" in paragraph 1.(b), however University does not propose that paragraph 1.(b) be changed except to clarify one point. University assumes that the exception clause was drafted for the benefit of University and the NRC Staff and not for CBG nor the City of Santa Monica, which would not maintain security information on the UCLA facility in the normal course of business.

However, as it reads the exception appli'es to any party.

University notes that under the procedures established in ALAB-592 (Section "4 Protective Order and Affidavit of Non-Disclosure") the intervenor organization itself was not permitted access to protected information.

University requests that this ambiguity be clarified.

t Statement of Professional Qualifications g

Mr. Ashbaugh is a lecturer and Associate Development Engineer for the Nuclear Energy Laboratory at UCLA. He has been a full-time employee since 1974 when he obtained his Senior Reactor Operator License.

He has an M.S.

in Nuclear Engineering, a Professional Engineering License with the state of California in Nuclear Engineering and teaches laboratory and theoretical nuclear engineering for UCLA and University Extension.

4 In connection with his duties at NEL, he has been the Security Officer since 1974.

His responsibility includes drafting and coordination of the security plan and its amendments, interfacing with the proper authorities I

on security matters, responsible for checking the functions of all the se-curity devices, and coordinating the control of personnel access to NEL.

Mr. Ashbaugh is familiar with the operating systems of the reactor and the consequences of malfunctions how ever caused.

NEILL C. OSTRANDER Nuclear Energy Laboratory University of California, Los Angeles Statement of Professional Qualifications My name is Neill Ostrander, I am employed by the University of California as a Senior Development Engineer.

I use the title Manager, Nuclear Energy Laboratory, as functionally descriptive of my employment.

I received the Bachelor of Science Degree in Chemical Engineering from the University of Washington in 1943, and spent the years until 1950 in the petroleum industry in the areas of research, development, engineering and operations.

From 1950 into 1954, I was employed as head of a mathematical physics group at the site of what is now called the Lawrence Livermore National La bora tory.

There I learned rea: tor physics by working with physicists, self-study, and doing calculations.

That was the common method of educating nuclear engineers prior to the formal development of-Nuclear Engineering curriculae.

During the years from 1954 into 1974, I was employed in various areas of the physical sciences, engineering, and applied mathematics.

In 1974 1 was invited to work for UCLA by the NEL founder and then Director, a man whom I had known personally and professionally since 1950.

It was not entirely coincidental that in 1956-57, I assisted in making criticality calculations for an Argonaut reactor that UCLA was contemplating for the campus. My association with UCLA has been lengthy but did not become intensive until 1974 I have been continuously employed in my present capacity since that time.

In connection with my responsibilities as Manager of the NEL I review the physical security plan and approve the changes made in the plan and its implementation.

I have participated in the disassembly and reassembly of the reactor.

I am familiar with operating systems of the reactor and the consequences of malfunctions in those systems how ever such malfunctions may be caused.

Walter F. Wegst, Ph.D.

Title:

Director of Research and Occupational Safety, UCLA Dr. Wegst is responsible for assessing the potential results of incidents occurring on the UCLA Campus involving hazardous materials and/or facilities, whether caused accidentally or deliberately.

In that capacity, he has become quite familiar with both the operating characteristics of the UCLA reactor and also with various aspects of the security of the facility.

(His degrees in Nuclear Engineering and Health Physics give him the technical knowledge to evluate the potential for and consequences of various acts of sabotage.)

He has already had discussons with members of the FBI and Los Angeles Police Department concerning potential acts of terriorism at the reactor facility. He is actively involved with planning for security for the reactor during the Olympic games.
