NOTICE OF DEPOSITION To: Randy Smith c/o Texas Utilities Generating Company 2001 Bryan Tower Dallas, Texas 75201 You are hereby notified that the Citizens Association for Sound Energy (" CASE") will take your oral deposition on Tuesday, June 22, commencing at 1:00 p.m. and continuing until completed. The deposition will be taken at the offices of Marshall Gilmore, Esquire, 1060 W. Pipeline Road, Hurst, Texas.

The deposition will relate to your activities during and knowledge of the construction of the Comanche Peak nuclear project and the performance of Charles Atchison.

Among other things, it will relate to deficiencies in pipe whip restraints, backfit programs, conduit support problems, and other const,ruction and quality assurance /

quality control failures. You should be prepared to state your knowledge of any such matters and to answer questions as to the date, location, and circumstances of each.
