CASE'S TENTH PROGRESS REPORT Pursuant to the Board's June 6,1986, Memorandum and Order (Progress Report and Notice of Available Documents), CASE submits its tenth progiess report.
As Applicants indicated in their 3/4/88 Tenth Progress Report, two meetings took place between Applicants and CASE last month which we believe are of special interest and potential significance:
(1) The February 18, 4
1988, meeting between Applicants and CASE; CASE witness Mark Walsh met with personnel of Applicants and their consultants regarding cable trays and cable tray supports, and other areas of design.
The meeting on Thursday was followed by a plant tour the next day (Friday).
(2) The February 25 and 26, 1988 meeting between Applicants and CASE; CASE witness Jack Doyle met with personnel of Applicants and their consultants regarding the piping and pipe supports, cable trays and cable tray supports, and other areas of design.
The meeting on Thursday af ternoon and Friday was followed by a plant tour the next day (Saturday). As we made clear at those meetings, there may be future additional comments and/or questions which we will have regarding h

those issues already discussed and/or yet toLbe discussed. We-believe that.
many of these can be handled on an informal basis, although we may also want to pursue some matters through the discovery process. As Applicants stated ~
in their 3/8/88. Motion to Consolidate Proceedings (page 16) both Applicants and CASE expect this informal process to continue in the future. CASE believes the informal discovery,.the meetings and the tours have been informative and helpful, and we look forward -to continued such cooperative processes in the future whenever possible.
l There is one area of concern to CASE regarding the transcripts of the meetings between Applicants and CASE. We note that the NRC Staff apparently has not sent copies of the transcripts of these meetings to the Board as Board Notifications as has been done regarding transcripts of meetings in which the Staff participated. The Staff has taken the position (as stated in the Staf f's 3/2/88 Note to File under
Subject:
Public Meeting Between TU Electric and CASE and Mark Walsh on February 18, 1988):
l "Since the NRC staff did not participate in this meeting, it is the staff's position that any determination as to whether the Atomic Safety and Licensing Board should be informed of this meeting should be made by the applicant or intervenor. The enclosures to this note are being placed in the NRC Public i
l Document Room and the Local Public Document Room."
l CASE believes that it is very important for the Board to obtain and l
l review the transcripts of such meetings between Applicants and CASE, and we strongly urge that the Board do so.
It is of further concern to CASE that apparently the Staff does not consider anything said by Applicants to CASE 1

during those meetings to be a commitment by Applicants to the Staff; I
l however, CASE is relying on Applicants' representations to help CASE decide those issues which we believe Applicants may have adequately resolved, what issues CASE still has concerns regarding, and what matters CASE believes it 2

still needs additional information regarding. The following transcripts of meetings between Applicants and CASE are, CASE believes, vital to the Board's understanding of the entire case, and we urge especially that the Board obtain copies of them (and attached Presentation Materials):
12/17/87 and 12/18/87; 2/18/88; and 2/25/88 and 2/26/88.
In regard to the difficulties CASE is having in attempting to obtain discovery f rom the NRC Staf f regarding trending and other inf ormation relevant to these proceedings (see more detailed discussion at pages 2 through 4 of our seventh Progress Report), the five FOIA ci.il suits filed by GAP are currently in progress in various stages; and we still expect to have additional questions of the NRC Staff.
CASE is also continuing its review and analyses of other documents received recently (such as those provided informally by Applicants and, most recently, the NRC Staff's SSER 14). The amount of work still before CASE is truly massive (as was discussed in some detail in CASE's 1/12/88 Progress Report at pages 4 through 6, and which has increased tremendously since that time).
The amount of documents which we have received and currently are trying to digest is now probably more easily discussed in terms of tons rather than pages.
It will obviously take CASE some time to review the materials which have resulted from Applicants' ef forts of over three years.
