NRC STAFF'S ElGHTH PROGRESS REPORT AND ANNOTATED BIBLIOGRAPHY

1. PROGRESS REPORT This progress report is prepared in response to the Licensing Board's "Memorandum and Order (Progress Report and Notice of Available Documents)" dated June 6,1986, and covers the period September 1,1987 through October 31, 1987. O
1. DISCOVERY This Staff attended depositions taken by Intervenors of Appil-cants' personnel on October 14-16, 1987.
2. CONSTRUCTION PERMITS The Atomic Safety and Licensing Appeal Board issued a decision en June 30, 1987 resolving the Staff's and Applicants' first and second appeals in the Comanche Peak Steam Electric Station (CPSES), Unit 1,

The Appeal Board majority affirmed the Licensing Board's admission of Amended Contention 2, stating that the Consolidated Intervenors had provided sufficient basis for the claims in the Amended Contention that Applicants had a policy to deliberately ignore or violate NRC requirements, and that the policy had not been actually repudiated by the Applicants. On July 17,1987 Appli-cants petitioned the Commission for review of the Appeal Board Decision.

The Decision became final agency action on October 6, 1987, as the time provided by NRC regulations within which the Commission may act to re-view the Decision expired and the Commission declined any review.

The Applicants' April 29, 1987 request for an extension of the latest construction completion date of Construction Permit CPPR-127 for CPSES, Unit 2, is still under Staff consideration. On October 23, 1987 the Staff requested additional information regarding local wells, Texas Water Development Board observation wells, and geologic features in the vicinity of the plant site in order to complete its evaluation of the effects of continued groundwater withdrawal for CPSES construction. Groundwa-ter withdrawal for construction is limited by a condition in the construc-tion permits, as amended.

OPERATING LICENSES On October 2,1987, the Staff responded to the App!! cant's mo-l tion filed on August 20, 1987 before the Licensing Board for establishment of a schedule for identification and litigation of matters that remain to be resolved under Contention 5. The Staff's response proposed Licensing Board adoption of an alternative litigation schedule. In preparation for a prehearing conference originally scheduled for October 20, 1987 and later i

changed to November 2-3, 1987, the Licensing Board requested the par-ties to respond to three questions and to propose a format for the pre-hearing conference. The Staff responded on October 29, 1987 to the Board's nuestions and proposed a format for the prehearing conference.

4 STAFF REVIEW AND EFFORTS The Staff is currently reviewing recent submittals by the Appli-cants on the engineering evaluation methodology of the post-construction hardware validation program (PCHVP) and the technical audit program and engineering functional evaluation (September 8, 1987) and on the PCHVP attribute matrix (September 23, 1987), some of which supplement previous submittals. The Staff is using this information to finalize a com-prehensive schedule for completing Comanche Peak licensing activities.

The Staff's schedule will focus on the Applicants' current fuel load readi-ness date of August 1988 and will be ready for release to all interested parties during the next reporting period.

Staff review and evaluation of the high priority licensing items listed in the sixth Progress Report is ongoing. On October 30, 1987, the Applicants submitted for Staff review a mark-up of the current Westing-house Standard Technical Specifications (STS) with specific changes for CPSES, Unit 1. Review of the marked-up STS is under way. The staff completed its review of the Applicants' request to eliminate arbitrary in-termediate pipe breaks in their analysis of high energy piping systems and transmitted a safety evaluation to the Applicants on October 13, 1987.

The Staff closed out Confirmatory issue 10m of the CPSES Safety Evalua-tion Report regarding NUREG-0797 Item II.K.3.31 (compliance with 10 C.F.R. 50.46 for small break LOCA analysis), issuing a safety evaluation

on October 26, 1987. On September 2, 1987 the- Staff requested additional information- from Applicants on implementation of Generic Letter i

83-28, "Required Actions Based on Generic implications of Salem ATWS Events," item 4.3, Parts 3 (life testing of breakers) and 4 (periodic replacement of breakers or components consistent with demonstrated life cycles) .

The Staff continued its review of the Applicants' design valida-tion activities associated with the Corrective Action Program (CAP), com-pleting the imtlat design inspection of the mechanical, civil / structural, electrical, and instrumentation and control design areas being reviewed by Stone and Webster Engineering Corporation (SWEC) and Ebasco Services, incorporated. The results of the initial design inspection are documented in inspection Peport 50-445/87-19; 50-446/87-14 issued on October 15, 1987. A follow-up inspection commenced on October 26, 1987 to resolve open items from the initial inspection and to review areas of design vall-dation that were not complete at the time the initial inspection was con-ducted. The Staff expects to complete this second design inspection during the next reporting period. The results of this inspection are ex-pected to be available in early 1988.

In the other CAP review areas (piping and pipe supports, cable tray hangers, conduit supports, and heating ventilation, and air condi-tioning (HVAC) supports), the staff has continued to review the resolu-tion of generic technical issues and audit the as-built procedures and procedure implementation, design criteria and methodology, and design verification being performed by SWEC, Ebasco, and Impell Corporation for the Applicants. Staff efforts in these areas conducted during this

s reporting period are documented in various audit and meeting summaries and trip reports which were provided to all parties. The Staff is con-ciuding its review of the pirang and pipe support issues and expects to issue a safety evaluation '.af this area in early 1988. Further audits of the Applicants' desig r. verification efforts in the areas of cable tray hangers, conduit supports, and HVAC will be conducted in early 1988.

The NRC Comanche Peak Allegation Review Committee ( AP.C) met on September 2,1987 and October 8,1987. The Committee discussed staff actions necessary to address 5 new allegations received during this reporting period. In addition, the ARC reviewed the status of past alle-gations and actions needed to close those that remain open.

5. ONSITE INSPECTION ACTIVITIES The NRC onsite inspectors and consultants continued their in-spections of construction, operations, and the Applicants' corrective ac-tion prcCram including issue Specific Action Plans, follow-up on previously identified NRC findings , nonconformance reports, and the post-construction hardware validation p rog ram. Concerted efforts have been made to reduce the time it takes to issue NRC inspection reports.

Consideraole improvement has been made towards the goal of issuing team inspection reports within 30 days and individual inspectors' reports within 20 days. During this reporting period, the following inspection reports were issued:

a. Inspection Report SG-445/8711; 50-446/8709 documents one viola-tion for improper electrical splices and one unresolved item for apperent improper disposition of nonconformance reports.
b. Inspection Report 50-445/8713; 50-446/8710 documents one viola-tion for failure to provide the torque requirements for bolts on the pres-sure boundary portion of a charging pump. The three unresolved items concerned the applicability of the ASME Boller and Pressure Vessel Code to capscrew installation, the homogeneity of HVAC work, and the qualifi-cation of inverters with spliced wire.
c. Inspection Report 50-445/8715; 50-446/8712 documents three l

unresolved items, the first concerning the Applicants' practice of chipping out concrete cracks to evaluate the extent or significance of the crack prior to documenting the crack as a potential nonconforming condition.

The second unresolved item concerned the practice of documenting defi-ciencies on inspection reports (irs). The NRC questioned this practice i

in the past because irs were not trended prior to 1985. The third

unresolved item involved electrical cables that were broken during pull-back. The open item involved the identification of a white' residue leeching through a concrete wall coating.

d. Inspection Report 50-445/8716; 50-446/8713 documents three violations one deviation , and nine open items. The first violation involved nonconformance reports (NCRs) being invalidated with no further action being requ! red when follow-up action appeared to be appropriate.

The second violation involved an undersized 6.9kv Jackshaft weld not be-ing identified during inspection. The third violation involved two cotter pins missing from a support. The deviation involved an administrative control of retesting following maintenance / modification of equipment that had been preoperationally tested. The nine open items all relate to NCRs. Two involved follow-up on the NCR review process and the other seven involved follow-up on the disposition of specific NCRs.

e. Inspection Report 50-445/8717 documents one open item regard-ing administrative control over preoperational testing.
f. Inspection Report 50-445/8720; 50-446/8716 documents two unre-solved items involved in the failure to write NCRs on potentially non-conforming conditions. The two open items involved the control of system cleanliness and protection of equipment and a broken stud on a pump motor body.

All of the above concerns will be followed up by NRC inspectors during the coming months.

Members of the NRC fire protection inspection team made a planning visit to the site on September 9-10, 1987 in preparation for the inspection which was conducted October 19-23, 1987. Results of the fire

protection team inspection and will be documented in an inspection report which the Staff expects to issue in early 1988. Representatives of the i

Texas State Department of Labor and Standards (ASME Code inspectors) were on site during this reporting period. NRC staff met with them periodically to discuss and coordinate the resolution of NRC issues involv-ing the ASME Code. The NRC approach to resolving outstanding NRC "open Itens" involving the ASME Code is outlined in a memorandum at-tached to inspection Report 50-445/8720; 50-446/8716 which was issued on October 22, 1987.

NRC staff performed an equipment qualification (EO) status review on October C-8, 1987 to determine an appropriate schedule for an EQ follow-up inspection. Dates for the follow-up inspection have not been established.

6. OTHER During this reporting period the Director, Office of Special Projects issued a decision concerning a 10 C.F.R. 2.206 Petition filed with the NRC on March 19, 1984 by the Government Accountability Project on behalf of the Citizens Association for Sound Energy and several CPSES nuclear workers. The Petition requested NRC to take certain actions with respect to alleged serious construction and documentation deficiencies at the CPSES. Relief requested included immediate suspension of construc-tion and the construction permit, a special NRC inspection at the facility, an independent design and construction verification program to assess the j integrity of the Comanche Peak Quality Assurance Program, and a com-prehensive management audit of the Applicants' officials by an indepen-dent management auditing firm. The request for special NRC inspections 1

has been granted. The other requests were denied as explained in "DI-rector's '. Decision Under 10 C.F.R. 2.206," DD-87-17 issued on October 16, 1987.

On September 4, 1987, representatives of the Apolicants met with regional safeguards and Office of Special Projects staff to discuss the reqlon's preoperational inspection experience in the security program area and how that experience might be applied to CPSES.

The Staff issued Preliminary Notification PNO-OSP-87-11 on Scotember 15, 1987 to report a construction accident at the site in which a mobile crane had overturned due to high winds crushing a temporary buildino and resulting in 2 fatalities.

During this reporting period the Staff completed record search-es on 7 Freedom of information Act requests related to CPSES received during August, September, and October 1987, b and received 11 new reauests for action. Approximately 44 5taff hours and over $700 in con-tract funds were expended in searching and preparing the responses for the 7 completed record searches.
