DOCKET NOS. 50-445 AND 50-446 Comments on Foderal Register Notice dated January 22,1999 Regarding Regulatory Assessment and Oversight Gentlemen:

The management of TU Electric and the Comanche Peak Steam Electric Station (CPSES) appreciate the opportunity to comment on the Federal Register dated January 22,1999 (Volume 64, Number 14), pages 3576-3578, regarding proposed changes to improve the inspection and assessment processes for overseeing the commercial nuclear power industry. ' We have reviewed the Federal Register and the program described in the SECY 99-007 along with the comments, prc iided by both the Region IV Utility Group (RUG IV) in their February 22,1999 letter and Nuclear Energy institute's (NEI) comments, as provided in their February 22,1999 letter.

TU Electric endorses the comments submitted by both RUG IV and NEl and believes that the proposed new program appears to appropriately reflect improvements in safety, reliability and performance of the nuclear power industry as well as the need for the NRC to regulate the industry effectively and efficiently. However, we wish to 0 reinforce the NEl and RUG IV comments that the Pls, the action matrix and associated NRC actions should continue to encourage aggressive self-identification of issues and conservative licensee decision making. Specifically, the inclusion of events in the Pls that were anticipatory in their nature (such as manual scrams, or power reductions intended to reduce the potential impact of extemal events on the plant) should be carefully considered to assure that including such events h LSe Pl does not penalize conservative decision making.
