NRC STAFF'S NINTH PROGRESS REPORT AND ANNOTATED BIBLIOGRAPHY PROGRESS REPORT This progress report is prepared in response to the Licensing Board's

"Memorandum and Order (Progress Report and Notice of Available Documents)"

dated June 6,1986, and covers the period November 1,1987 through Decem-ber 31, 198 . Discovery There has been no change in the status of discovery during this reporting perio However, in a letter dated December 2,1987 to the Citizens Association for Sound Energy (CASE's) counsel, the Staff set forth its intentions regarding how it will make documents available to the parties in the Comanche Peak Steam Electric Station (CPSES) operating license proceedings once the Staff issues a Supplemental Safety Evaluation on a given Applicant Project Status Report (PSR). On December 9,1987, CASE counsel responded advising that the Staff's intentions do not solve the problem of CASE accessing

f, -2- Construction Permits The Applicants' April 29, 1987 request for an extension of' the latest construction completion date of Construction Permit CPPR-127 for CPSES, Unit 2, is still under Staff consideratio On December 12, 1987, the Ap-plicants responded to the S taff's October 23, 1987 request for additional information regarding local wells, Texas Water Development Board observation wells, and geologic features in the vicinity of the plant sit The staff requested this information in o'rder to cohiple'e t its evaluation of the effects of continued groundwater withdrawal for CPSES constructio Groundwater with-drawal for construction is limited by a condition in the construction permit, as amende . The Board issued a Memorandum and Order on November 18, 1987 to establish the litigation schedule governing discovery and the resolution of issues in the CPSES cas '

prog ram On November 13, 1987, the Staff requested CASE to provide specific comments and concerns on the Applicants' corrective action efforts so that the comments and concerns could be considered during development of the Staff's evaluatio The Staff conducted a public meeting on December 9,1987 to discuss the status of the Applicants' corrective action efforts, including the Corrective Action Program (CAP) and the Comanche Peak Response team activities, and to obtain clarifications needed by the Staff in order to complete their evaluation of the Applicants' program CASE was given an opportunity at the meeting to provide comments for Staff consideratio The Staff is using the information obtained during this meeting and in a December 18, 1987 letter from App!! cants responding to Staff comments during the meeting on the corrective action efforts, es well as clarifications on the CAP documented by Applicants in a November 25, 1967 letter to the Staff, to finallze the Staff evaluatio The evaluation stating the conditions for acceptability of the Applicants' correct;ve action programs, including a condition for approval by the Staff prior to implementation of any changes to the programs, is expected to be issued in the next reporting perio On December 15, 1987 the Staff provided the Board and all parties in the

Scheduled dates will be revised periodically as the Staff receives new information on the activities associated with the schedul Staff review and evaluation of licensing items is ongoin On December 3, 1987, the Staff transmitted for Applicants' review a markup of the first draft Technical Specifications (TS) for CPSES, Unit A meeting between the

Staff and Applicants to discuss the first draft TS in detail was held January 11-15, 198 On November 12, 1987, the Staff met with the Applicants to discuss an open Final Safety Analysis Report review item on the jet impingement effects in the break exclusion region of the main steam and feedwater piping at CPSES, Units 1 and The Staff met with Applicants on December 16, 1987 to discuss the Applicants' plans to implement the new broadscope CDC 4 rule, which allows the use of advanced fracture mechanics analysis (leak-before-break technology) to preclude the need for dynamic effects of pipe ruptures in the plant desion basi Also discussed at this meeting was Stone and Webster Engineering Corporation's (SWEC's) efforts to validate the CPSES seismic building response spectr The Staff attended a meeting between the Applicants and CASE which was a continuation of discussions on pipe supports started in March 198 In addition to discussing piping and pipe support issues , the Applicants pre-sented an overview of several CAP scopes of work and conducted a plant tour to show examples of hardware corrections currently under wa The Staff continued its review of the Applicants' design validation activlties associated with the CAP, completing the second design inspection of the mechanical, civil / structural, electrical, and instrumentation and control

(1) documents listed on the package inventory card not agreeing with the document package contents issued by the Paper Flow G roup , (2) an engineering evaluation not being performed on an inaccessible weld attribute due to erroneous acceptance by a QC inspector, (3) a nonconformance report (NCR) not being issued for a failed capscrew on a pipe support, and (4)

actions required in the disposition of an,NCR not having been accomplishe The deviation concerns multiple errors l$ recording as-built information, such as dimensions, during a walkdown. The unresolved items involve the shimming of steam generator holddown bolts and two undocumented capacitors in the CPSES, Unit 1, diesel generator control panel The latter item has been docurrented as a violation in inspection Report 50-a45/8730; 50-446/8722 (see paragraph 5. f) . The open items are related to tagging and control of electrical work in progress, the use of problem identification sheets, deficiency !

relating to a missed inspection 6f an attribut Inspection ' Report 50-445/8730; 50-446/8722 documents two violations (failure to control modifications and failure to control drawings), both of which resulted from NRC follow-up on the two capacitors installed in the CPSES, Unit 1, diesel generator control panels (see 5.a) . The five open items all relate to electrical issues: taped electrical joints, cable pulling lubricant, abandoned cable pulling aids, separation requirements, and electrical pene-tration assemblies in isolation valve tank Inspection Report 50-445/8731; 50-446/8723 documents one violation and one deviation, both concerning multiple examples of errors in recording as-built information during walkdown The second violation concerns examples of improper closecut of NCR The unresolved item involves inconsistencies of dates in a calculation package (the summary of loads and checking the calculations dated prior to the date of some other calculation These inspection reports were issued within an average of 16 days after the end of the inspection perio The fire protection team inspection which was performed October 19-23, ,
