NOTICE OF LIMITED RELEASE OF PROTECTIVE ORDER In the summer of 1984, during the harassment and intimidation hearings, CASE provided a witness who agreed to testify and provide information only under the terms and conditions of a protective order.

That protective order was entered and since that time all of the parties have continued to comply with its terms.

Compliance with its terms has resulted in a relatively discreet amount of material being maintained under the protected conditions envisioned by the order.

At this time Witness F has agreed, at the request of counsel, to withdraw the request for a protective order "as to

.all issues and documents and testimony, " except for the use of his name.1/

(See, enclosed AFFIDAVIT, submitted separately because it contains the signed affidavit of Witness F, and thus reveals definitively his name.)

1/ CASE's counsel, Billie Garde, has represented Witness F in DOL proceedings and in the context of the NRC's investigation of his allegations, 8712090057 871124 ADOCK O g5 gDR

[rl CASE's counsel has reviewed the materials currently covered

$$jh[undertheprotectiveorderinherpossessiontodeterminetowhat extent the witnesses name is actually used, and has determined that in order to accommodate the witness's reasonable request for the protection from public exposure the name of Witness F, it will be necessary to undertake a review and redacting of all documents.

CASE volunteers to undertake that redacting, if the Board desires that it should do so, and to file one set of the redacted materials with the Board.2/

Alternatively, CASE believes that the Staff has personnel that are skilled at redacting the names from documents being prepared for public release and could also perform a review and redacting of the materials.

CASE files this motion without attachment to all members of the service list, except the Board members, and the principal attorney for the Applicant and the Staff.
