DOCKET NOS. 50-445 AND 50-446 Comments on Federal Register Notice dated May 19,1999 Regarding Revision of NRC Enforcement Policy NUREG-1600, Rev.1 and Amendment of 10 CFR 55.49 Gentlemen:
The management of TU Electric and the Comanche Peak Steam Electric Station
~ (CPSES) appreciate the opportunity to comment on the Federal Register dated May 19,1999_(Volume 64, Number 96), pages 27310-27312, regarding proposed changes
- to enforcement policy. We have reviewed the Federal Register and concur with the need to provide examples that may be used as guidance in determining the appropriate severity level for violations involving the compromise of licensed operator application tests and examinations. However, we believe that the policy as written, and the examples provided, leave open the potential for unwarranted enforcement action against innocent individuals who were not party to and who had no knowledge, prior or otherwise, of any compromise of any part of the examination or the examination process.
