Re: Turkey Point Units 3 Docket Nos. 50-250 Defueled Surveillance Testin Due to our outage for repair of the Unit 3 steam generators, and in accordance with Amendment 69 to our facility operating license (DPR-31), we have defueled the Unit 3 reactor and will maintain it in that condition until the repairs are complete. Our Technical Specifications specifically waive many of the surveillance requirements during various shutdown conditions. In addition, we have identified some other surveillance requi rements which, though not specifically exempted for normal shutdowns, are clearly not required when no fuel is in the reactor. These requirements are:

Technical Speci fication 4.4.2.2, Personnel and Emergency Air Lock Tests

2) Technical Specification 4.4.2.3, Equipment Access Hatch Test
3) Technical Specification 4.7. 1, Emergency Containment Filter-Operating Test
4) Technical Specification 4.7.1.3, Emergency Containment Filters-Laboratory Test
5) Technical Specification 4.5.2.a, Residual Heat Removal Pump Tests The equipment tested by the above specifications is not required to be operable when no fuel is in the reactor and there is no conceivable occurrence in this condition which would call upon the equipment to perform its safety function.

We intend to test the equipment prior to reloading fuel into the reactor and to resume normal surveillance testing frequency at that time.

We have discussed this matter and have reached agreement on it with our resident NRC inspector.
