PEACH BOTTOM ATOMIC POWER STATION - NRC DEVIATION MEMORANDUM INSPECTION - INATTENTIVE SECURITY OFFICER ROOT CAUSE CORRECTIVE ACTION EVALUATION - INSPECTION REPORT NOS.

05000277/2008404 AND 05000278/2008404

Dear Mr. Pardee:

On March 7, 2008, the U.S. Nuclear Regulatory Commission (NRC) completed a Deviation Memorandum inspection at your Peach Bottom Atomic Power Station (PBAPS). The enclosed inspection report documents the inspection results, which were discussed on March 6, 2008, with Mr. Michael Massaro, Plant Manager, and on March 7, 2008, with other members of your staff.

On November 23, 2007, the NRC Executive Director for Operations approved a Deviation Memorandum (ML073320344) which provides for enhanced oversight of PBAPS. This enhanced oversight includes additional inspections in the areas of security force performance monitoring, corrective action effectiveness, safety conscious work environment, and verification of Confirmatory Action Letter (ML072920283) commitments.

The purpose of this inspection was to evaluate the effectiveness of the corrective actions taken in response to the inattentive security officer events discovered in September 2007. The NRC inspection approach included procedure and corrective action reviews, individual and management interviews, record reviews, walkdowns, security turnover observations, and discussions to gather input and comments directly from site workers. The inspectors also observed work activities and meetings.

Overall, the results for the material reviewed during this inspection indicate that the corrective actions taken as a result of the inattentive security officer events have been generally effective, and that you have made progress integrating use of the corrective action program within the security organization. No findings of significance were identified during this inspection.

When separated from its Enclosure, this Document is DECONTROLLED. Mr. As part of our normal assessment process, this inspection will be one of the inputs for our PBAPS mid-cycle review which will be conducted during the summer of 2008. The mid-cycle review will collectively assess Deviation Memorandum and Confirmatory Action Letter inspection results in conjunction with a review of the last 12 months of Reactor Oversight Process baseline inspection activity and performance indicators.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system, ADAMS. ADAMS is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related information contained in the enclosure, and in accordance with 10 CFR 2.390, a copy of this letters enclosure will not be available for public inspection.

In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response, if any. This practice will ensure that your response will not be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system, ADAMS. If Safeguards Information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21. Otherwise, mark your entire response Security-Related Information - Withhold Under 10 CFR 2.390 and follow the instructions for withholding in 10 CFR 2.390(b)(1).
