CRYSTAL RIVER UNIT, 3 - DOCUMENTATION OF VERBAL APPROVAL FOR RELIEF REQUEST (TAC NO. MC8993)

The purpose of this memorandum is to document the staffs actions in providing verbal approval to the licensees request for relief from the requirements of Title 10 to the Code of Federal Regulations (10 CFR) Part 50, Section 55a.

By letter dated November 23, 2005 (ML053560207), pursuant to 10 CFR 50.55a(g)(4)(iv), Florida Power Corporation, doing business as Progress Energy Florida, requested NRC approval to use a later edition of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel (B&PV) Code for welder qualifications who welded an Inconel 690 plug in a Once-Through Steam Generator to repair a previously plugged tube. Specifically, the welding procedures and welder qualifications of the vendor performing the plug welding meets all of the requirements set forth in the ASME B&PV Code Section XI, Article IWA-4000, Paragraph IWA-4712, Fusion Welding, 1998 Edition, 2000 Addenda; as opposed to the Code of record (i.e., Article IWB-4000, Sub-subarticle IWB-4230 of the 1989 ASME Edition). It was the staffs understanding that the licensee performed the welding at risk prior to their submittal.

Crystal River Unit 3 is currently shut down with Mode 3 scheduled for December 6, 2005 (i.e., when both steam generators need to be considered operable). Due to the licensees need for approval prior to restart, on December 1, 2005, the staff granted verbal approval pursuant to guidance found in LIC-102, Revision 1, Relief Request Reviews. The verbal approval was granted via a telephone conference call among Paul Infangar of Florida Power Corporation, John Tsao, acting Branch Chief of the Flaw Evaluation & Welding Branch (CFEB), John Honcharik, the lead reviewer of CFEB, Michael Marshall, Branch Chief of Plant Licensing Branch II-2, and me.

The staff informed the licensee that, by procedures, we will issue a final written safety evaluation within 30 days.
