On February 11 - 12, 2020, the U.S. Nuclear Regulatory Commission (NRC) completed an on-site inspection under Inspection Manual Chapter 2690, Inspection Program for Dry Storage of Spent Reactor Fuel at Independent Spent Fuel Storage Installations and for 10 CFR Part 71 Transportation Packagings. The inspector examined activities conducted under your license as they relate to safety and compliance with the Commission's rules and regulations and the conditions of your license. The inspection consisted of observations by the inspector, interviews with personnel, and a review of procedures and records. The results of the inspection were discussed with you and other members of the CR-3 staff on February 12, 2020 and are described in the enclosed report. No findings of safety significance were identified.

SUMMARY
Duke Energy Crystal River Nuclear Plant NRC Inspection Report Nos. 07201035/2020001 An announced CR-3 on-site inspection was performed February 11 - 12, 2020. The inspector assessed whether CR-3 personnel were operating and maintaining the independent spent fuel storage installation (ISFSI) in conformance with the commitments and requirements contained in the Final Safety Analysis Report (FSAR), Safety Evaluation Report (SER), Certificate of Compliance (CoC), Technical Specifications (TS), Quality Assurance (QA) program, site procedures, and 10 Code of Federal Regulations (CFR) Part 72. The inspection consisted of observations by the inspector, interviews with site personnel, a review of procedures and records, and walk-downs. The NRC's program overseeing ISFSIs is described in Inspection Manual Chapter 2690, Inspection Program for Dry Storage of Spent Reactor Fuel at Independent Spent Fuel Storage Installations and for 10 CFR Part 71 Transportation Packages.
Based on the results of this inspection, no findings of safety significance were identified.

REPORT DETAILS
1.0 Background
On February 20, 2013, Duke Energy sent a letter [Agency Documentation and Management System Accession Number ML13056A005] to the NRC certifying the permanent cessation of activities and certifying that the fuel had been permanently removed from the reactor. This met the requirements of 10 CFR 50.82(a)(1)(i) and 50.82(a)(1)(ii). CR-3 is currently in the SAFSTOR phase of decommissioning as described in IMC 2561. CR-3 completed offloading the spent fuel pool to the ISFSI on January 12, 2018. On June 14, 2019, the NRC received and is considering approval of a license transfer application [ML19170A209] and conforming amendment filed by the Duke Energy Florida (DEF), LLC on behalf of itself and Accelerated Decommissioning Partners (ADP) CR3, LLC. The application seeks NRC approval of the direct transfer of Facility Operating License No. DPR-72 for CR-3 and the general license for the CR-3 ISFSI from the current holder, DEF to ADP CR3, which is a wholly owned subsidiary of ADP, LLC.
2.0 Operation of an Independent Spent Fuel Storage Operation
- a. Inspection Scope [Inspection Procedure (IP) 60855]
ISFSI facilities where loading operations have been completed are essentially passive operating facilities. The inspector evaluated the licensees activities related to long-term operation and monitoring of their ISFSI. The inspector assessed whether CR-3 personnel were operating and maintaining the ISFSI in conformance with the commitments and requirements contained in the FSAR, SER, CoC, TS, QA program, CR-3 procedures, and 10 CFR Part 72.
The inspectors review was directed towards confirming the ongoing adequacy of the radiation protection, fire protection, emergency preparedness, surveillance, maintenance, environmental monitoring, training, QA, and corrective action programs as they relate to ISFSI monitoring activities.
The inspector observed activities, performed walk-downs interviewed personnel, and reviewed records and procedures. The inspector also reviewed a sample of changes screened and evaluated by Duke Energy under 10 CFR 72.48 to verify that they did not require prior NRC approval, that changes were consistent with the license or CoC, and that they did not reduce the effectiveness of any programs or processes.
- b. Observations and Findings The inspector determined that 10 CFR 72.48 screenings and evaluations had been properly performed and that Duke Energy had trained and qualified individuals to perform the evaluations. The inspector determined that changes under 10 CFR 72.48 did not require prior NRC approval.

The inspector determined that issues associated with the ISFSI, including those from the recent emergency preparedness drill, had been identified and entered into the corrective action program in a timely manner and the issues were effectively screened, prioritized and evaluated commensurate with their safety significance. The inspector verified audits had been performed by qualified individuals independent of the organization being audited and that management reviewed the audits and associated corrective actions.
The inspector also reviewed CR-3s 10 CFR 72.212 evaluation report and ensured it was being appropriately updated.
Daily temperature monitoring of the horizontal storage modules was performed by CR-3 personnel in accordance with surveillance requirements in the TS. CR-3 procedures contain backup plans if the primary surveillance method was unavailable. The inspector performed a tour of the ISFSI pad and to assess its material and radiological conditions.
The inspector also verified that transient combustibles had not been stored on the ISFSI pad or in the vicinity of the HSMs and confirmed vehicle entry onto the ISFSI pad was controlled in accordance with site procedures 4.0 Exit Meeting Summary On, February 12, 2020, the inspector presented the inspection results to Mr. Terry Hobbs, Decommissioning General Manager, and the rest of the CR-3 staff. The inspector verified that no proprietary information was retained by the inspector or documented in this report.
