CRYSTAL RIVER UNIT 3 - SUPPLEMENTAL INFORMATION NEEDED FOR ACCEPTANCE OF THE APPLICATION FOR A LICENSE AMENDMENT REGARDING APPROVAL OF THE LICENSE TERMINIATION PLAN (EPID L-2022-LLA-0194)

Dear Billy Reid:

By letter dated December 12, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No ML22355A441), Accelerated Decommissioning Partners Crystal River Unit 3, LLC (ADP CR3) applied for an amendment to Facility Operating License No. DPR-72 for the Crystal River Unit 3 Nuclear Power Station (CR3). The license amendment request (LAR) proposes to add License Condition 2.C.21 that approves the License Termination Plan (LTP) and adds a license condition that establishes the criteria for determining when changes to the LTP require prior NRC approval.

The U.S. Nuclear Regulatory Commission (NRC) staff performed an acceptance review of the LAR and LTP and concluded that the LTP did not provide technical information in sufficient detail to enable the staff to complete its detailed review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements for the protection of public health and safety and the environment. The enclosure to this letter describes the information needed, primarily site characterization data, for NRC staff to continue the acceptance review of the LTP. This information is used to inform the other parts of the LTP, such as sections on remediation plans, final radiation survey plans and the demonstration of compliance with the radiological criteria for license termination. The lack of sufficient site characterization information would prevent staff from completing a technical review of those sections of the LTP. Once the NRC staff receives sufficiently detailed site characterization information, we will continue our acceptance review of the LTP.

The information requested in the enclosed table is based on review of the LTP against the guidance for acceptance and safety reviews of LTPs in NUREG-1700, Rev. 2, and/or the applicable sections or appendices in NUREG-1757, Vol. 2, Rev. 2, on site characterization surveys.

The NRC staff requests a supplement or revision to the application to address the information described in the enclosure to this letter by June 1, 2023. If the supplement or revision is not received by the agreed date, the application may not be accepted for review pursuant to 10 CFR 2.101, Filing of application, and the NRC may cease its associated review activities.

Any request for additional time to provide the supplement or revision should include the reason for requesting additional time and a proposed date to provide the supplement or revision to allow the NRC staff to make an informed decision on whether to grant the request.

If the application is subsequently accepted for detailed technical review, you will be advised of any further information needed to support the staffs detailed technical review by separate April 19, 2023 correspondence. If needed, a conference call or pre-submittal meeting should be arranged with the NRC staff to discuss the information required to supplement or revise the application as described in the enclosure.

The decision on how to supply the information to address the identified deficiencies in the LTP LAR acceptance review (supplementing the LAR vs revising the LAR and resubmitting) is yours to make. However, revising and resubmitting the LAR will allow for a more effective and efficient review of the application by NRC rather than supplementing the current version of the LTP LAR.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
