ANNUAL ASSESSMENT LETTER FOR CRYSTAL RIVER NUCLEAR PLANT UNIT 3 (REPORT 05000302/2012001)

Dear Mr. Franke:

On February 13, 2013, the NRC completed its end-of-cycle performance review of Crystal River Nuclear Plant Unit 3. The NRC reviewed the most recent quarterly performance indicators (PIs)

in addition to inspection results and enforcement actions from January 1, 2012, through December 31, 2012. This letter informs you of the NRCs assessment of your facility during this period and its plans for future inspections at your facility.

The NRC determined that overall, Crystal River Unit 3 operated in a manner that preserved public health and safety and met all cornerstone objectives. The NRC determined the performance at Crystal River Unit 3 during the most recent quarter was within the Licensee Response Column of the NRC=s Reactor Oversight Process (ROP) Action Matrix because all inspection findings had very low (i.e., green) safety significance, and all performance indicators indicated that your performance was within the nominal, expected range (i.e., green).

Therefore, the NRC plans to conduct ROP baseline inspections at your facility.

The NRC determined the performance at Crystal River Unit 3 during the first two quarters of the assessment period was within the Regulatory Response Column of the NRCs ROP Action Matrix because of one White finding in the Emergency Preparedness cornerstone. This White finding was closed in Inspection Report 05000302/2012503 dated June 14, 2012 (ML12166A522). Crystal River Unit 3 transitioned back to the Licensee Response Column of the Action Matrix on July 1, 2012, as documented in Inspection Report and Assessment Follow-Up Letter 05000302/2012003 dated July 27, 2012 (ML12209A382). Crystal River Unit 3 remained in the Licensee Response Column for the rest of this inspection cycle.

On February 20, 2013, Florida Power Corporation certified to the NRC the permanent removal of fuel from the Crystal River Unit 3 reactor vessel. The NRC has been conducting baseline inspections in accordance with Inspection Manual Chapter (IMC) 0351, Implementation of the Reactor Oversight Process at Reactor Facilities in an Extended Shutdown Condition for Reasons Other Than Significant Performance Problems. The NRC is currently developing an inspection plan for Crystal River Unit 3 consistent with IMC 2561, Decommissioning Power Reactor Inspection Program. While this inspection plan is being developed, the NRC intends to conduct inspections at your facility in accordance with the current IMC 0351 inspection plan (ML13016A115). However, the NRC will contact you as soon as possible regarding changes to the inspection plan that are commensurate with the implementation of your decommissioning schedule.

The enclosed inspection plan lists the inspections that are scheduled through June 30, 2014.

Routine inspections performed by resident inspectors are not included in the inspection plan.

As a result of your announcement to decommission Crystal River Unit 3, the inspections listed on the enclosed plan will be revised. The NRC provides inspection plans to allow for the resolution of any scheduling conflicts and personnel availability issues. This inspection plan does not include security related inspections, which will be sent via separate, non-publicly available correspondence.

In accordance with 10 CFR 2.390 of the NRC=s ARules of Practice,@ a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
