CONCLUSION OF SECTION 106 CONSULTATION REGARDING THE LICENSE TERMINATION PLAN FOR CRYSTAL RIVER UNIT 3 IN CITRUS COUNTY, FLORIDA (DOCKET NUMBER: 50-302)

Dear Chief Lewis Johnson:

The U.S. Nuclear Regulatory Commission (NRC) is conducting an environmental review for a license amendment requesting approval of a license termination plan (LTP) for Crystal River Unit 3 (CRU3) submitted by Accelerated Decommissioning Partners (ADP) CR3, LLC (ADP CR3) on December 12, 2022, pursuant to Title 10 of the Code of Federal Regulations Part 50.

The CRU3 is located at 15760 West Powerline Street in Crystal River, Florida, within the Crystal River Energy Complex. ADP intends to meet the criteria for unrestricted release found in 10 CFR 20.1402. After license termination for most of the CRU3 site, a small portion of the site used for the dry storage of spent nuclear fuel (also known as an independent spent fuel storage installation) would remain under NRC license.

By letter dated April 2, 2024, the NRC staff initiated Section 106 consultation and notified the Advisory Council on Historic Preservation (ACHP), Florida State Historic Preservation Officer (SHPO), and four Indian Tribes of its decision to use the National Environmental Policy Act of 1969 (NEPA), as amended, process to comply with its obligations under Section 106 of the National Historic Preservation Act of 1966, as amended, in accordance with 36 CFR 800.8(c).

As part of the aforementioned correspondence, the NRC staff indicated that a draft environmental assessment (EA) pursuant to NEPA was being prepared to determine whether to prepare an environmental impact statement or finding of no significant impact (FONSI). At that time, a copy of the historic and cultural resources sections of the draft EA was made publicly available for review and comment ( ML24088A272). The publicly available historic and cultural resources section included identification of historic and cultural resources and historic properties, an analysis of potential effects of the proposed action, including potential effects on historic and cultural resources and historic properties as well as the NRC staffs preliminary determination of no historic properties affected. The purpose of this letter is to provide final project details and information on publication of the final EA and final FONSI as well as to conclude consultation.

In addition to the ACHP and Florida SHPO, the following consulting parties received consultation correspondence (Section 106 initiation and availability of the draft EA historic and cultural resources section), inviting input on the areas of potential effect, identification and evaluation efforts, information on resources of traditional or religious importance, and the NRC staffs determination of effect:

- May 20, 2024 oFlorida SHPO: Concurred with the NRC staffs assessment ( ML24143A021)

The Florida SHPO concurred with the NRC staffs finding of no historic properties affected on May 20, 2024, and no consulting party has objected. Therefore, consistent with 36 CFR 800.4(d)(1)(i), NRCs responsibilities under Section 106 are complete.
