CRYSTAL RIVER UNIT 3 NUCLEAR GENERATING PLANT - CORRECTION TO SAFETY EVALUATION RELATED TO THE ISSUANCE OF AMENDMENT NO. 259 APPROVING THE INDEPENDENT SPENT FUEL STORAGE INSTALLATION ONLY EMERGENCY PLAN (EPID L-2021-LLA-0047)

Dear Mr. Reid:

By letter dated October 13, 2021 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML21238A095), the U.S. Nuclear Regulatory Commission (NRC) issued the Amendment No. 259 to Facility License No. DPR-72 for the Crystal River Unit 3 Nuclear Generating Plant (CR-3). The amendment approved the CR-3 Independent Spent Fuel Storage Installation (ISFSI)-Only Emergency Plan (IOEP) as requested by the letter from Accelerated Decommissioning Partners (ADP) CR-3, LLC dated March 17, 2021 (ADAMS Accession No. ML21076A386). Subsequent to issuance of the amendment, your staff informed me that a sentence in the safety evaluation, describing staffing by the Security Shift Supervisor at the ISFSI, would not be implemented until after approval of the CR-3 license amendment request to revise the ISFSI Security Plan, also dated March 17, 2021 (ADAMS Accession No. ML21085A750), and that therefore the sentence should be removed from the safety evaluation.

As originally submitted, both the CR-3 IOEP and the ISFSI Security Plan revisions were requested to be approved on the same time schedule (by January 2022). While the IOEP revision was ready for approval by NRC by October 13, 2021, the ISFSI Security Plan revision is still under NRC review. As staffing by the Security Shift Supervisor at the ISFSI is not a requirement of the IOEP, the sentence describing that staffing in the safety evaluation of the IOEP revision should be removed as Security Shift Supervisor staffing at the ISFSI will be required and implemented through the revised ISFSI Security Plan.

The NRC staff has concluded that the correction will not change any of the conclusions in the safety evaluation associated with the amendment or the amendment itself. Accordingly, to this letter provides the corrected page for the Safety Evaluation approving Amendment No. 259 to Facility License No. DPR-72.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
