REPLY TO REQUEST FOR EXTENSION FOR REPONSE TO THE REQUEST FOR ADDITIONAL INFORMATION - CRYSTAL RIVER UNIT 3 NUCLEAR GENERATING PLANT - FOR ACCELERATED DECOMMISSIONING PARTNERS CRYSTAL RIVER REQUEST TO ADD LICENSE CONDITION TO INCLUDE TERMINATION PLAN REQUIREMENTS (EPID NO. L-2022-LLA-0194)
Dear Mr. Reid:
By letter dated December 12, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22355A441), as supplemented by letter dated June 9, 2023 (ML23163A063), Accelerated Decommissioning Partners Crystal River Unit 3, LLC (ADP CR3)
(the licensee) requested U.S. Nuclear Regulatory Commission (NRC) approval of an amendment request to add a condition to include License Termination Plan (LTP) requirements to NRC License No. DPR-72 for the Crystal River Unit 3 Nuclear Generating Plant (CR3).
The proposed amendment, if approved, would add License Condition 2.C.21, which would establish the criteria for determining when changes to the LTP require NRC approval. The LTP would be implemented by the licensee to complete decommissioning activities at the CR3 site.
Once decommissioning is complete, a separate request would be made to the NRC by the licensee to terminate the CR3 license.
By letter dated December 22, 2023 (ML23354A063), the NRC staff sent a request for additional information (RAIs) identifying information needed for the NRC staff to continue its review of the LTP. The NRC staffs December 22, 2023, letter requested that ADP CR3 provide responses to the RAIs by February 20, 2024. On February 21, 2024 (ML24054A646) ADP CR3 requested additional time to respond to the RAIs, citing the need for additional laboratory results and internal quality control checks associated with revisions to the LTP.
The NRC staff reviewed your February 21, 2024, request and agrees that having complete and accurate results of lab analysis along with appropriate site characterization would better utilize staff time and resources. Therefore, the NRC staff will extend the response date to March 31, 2024. Upon receipt of your RAI responses, the NRC staff will develop a feasible review schedule or confirm the possibility of adhering to the initially proposed timeline.
In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
