Dear Ms. Bauman:

By letter cated December 24, 1987, I responded in part to your letter dated October 15, 1987, in which you appealed NRC's initial response to your Freedom of Information Act (F0!A) request F01A-87-590. I noted in my December 24, 1987 letter to you that the NRC staff was reviewing one additional document subject to your request. That review is now complete, and the document is addressed below.

Portions of the document identified on the enclosed Appendix 0 are bein I

withheld from public disclosure pursuant to Exemption (3) of the5 FOIA (g U.S.C. 552(b)(3)) and 10 CFR 9.17(a)(3) of the Comission's regulations. The withheld portions contain unclassified safeguards information. The statutory authority for withholding this infonnation is found in Section 147 of the AtomicEnergyAct(42U.S.C.2167). The nonexempt portions of the document are enclosed.

Pursuant to 10 CFR 9.25(b) of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Robert D. Martin, Regional Administrator, NRC Region !Y.

This denial may be appealed to the NRC's Executive Director for Operations within 30 days of the receipt of this letter. As provided in 10 CFR 9.29(a),

any such appeal must be in writing, addressed to tie Executive Director for l Operations, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an "Appeal from an Initial F0!A Decision."

Three records have been referred to other agencies for disclosure determinations and direct responses to ycu.

This completes action on your appeal 87-A-92.

This refers to the inspection conducted by Messrs. James A. F. Kelly and A. B. Earnest of this office during the periods Aprl) 20 and 27 through May 1, 1987, of activities authorized by NRC Construction Permits CPPR-128 and CPPR4129 for South Texas Project, and to the discussion of our findings with Mr. A. O. Hill and other members of your staff at the conclusion of the inspection.

Areas examined during the inspection included security plan and procedures, management effectiveness, security organization, audits, records and reports, testing and r.4aintenance, locking systems, physical barrier - protected area, physical barriers - vital areas, power supply, lighting, compensatory measures, assessment aids, access control personnel, access control packages, access control - vehicles, detection aids - protected area, detection aids vital areas, alarm stations, communications, personnel training and qualifications, safeguards contingency plan, and the protection of safeguards information.

Within these areas, the inspection consisted of selective examination of procedures and representative records, interviews with personnel, and nbservations by the NRC inspectors. The inspection findings are documented in the enclosed inspection report.

Within the scope of the inspection, no violationt or deviations were identified.

The material enclosed herewith contains Safeguards Information as defined by 10 CFR Part 73.21 and its disclosure to unauthorized individuals is prohibited by section 147 of the Atomic Energy Act of 1954, as amended.
