Dear Mr. O'Neill:

This is in further response to your letter dated June 19, 1984, in which you requested, pursuant to the Freedom of Information Act (F0IA), three categories of records related to NUREG-1055. This also responds to Mark Engelman's subsequent letter dated November 8,1985.

Enclosed are copies of the November 25, 1985, letter and its enclosures provided to Mr. A. P: trick Leighton with regard to his F0IA request (F01A-84-293) regarding NUREG-1055.

The 17 records identified on the enclosed Appendix 0 are already available for public inspection and copying at the NRC Public Document Room (PDR).

The 103 records identified on the enclosed Appendix P are now available for public inspection and copying at the PDR in folder F01A-84-293 under the name Leighton.

In conversations between Mark Fogelman of your staff and David Meyer of my staff on October 31 and November 1,1985, it was agreed that we would provide you with a copy of each document identified on Appendix P. These records have been sent to you under separate cover. As also discussed in these conver-sations, item 101 on Appendix P is a bibliographic list of material reviewed in conjunction with the Diablo Canyon case study prepared as part of NUREG-1055.

This list identifies documents reviewed by but which may not have been in the possession of the NPC Quality Assurance Review Team. These documents were reviewed at various locations, such as utility headquarters, resident inspector offices, or regional offices and, thus, were not among the records maintained or provided to me by the Quality Assurance Review Team. We understand, however, that many of these documents are docket-related, copies of which may be maintained by the licensee and in the docket file at the PDR. In the event there are any NRC records included on this list which you have not obtained from the licensee or the PDR and you wish to inspect-these records, you may submit a separate F0IA request for these records.

[-U <Ph The California Public Utilities Commission is currently engaged in a review of the costs incurred in constructing the Diablo Canyon Nuclear Power Plant. One of the areas under study is the utility's quality assurance program.

A recent NRC study entitled " Assurance of Quality In Nuclear Construction Projects", published as NUREG 1055, contains a useful discussion of quality assurance programs at seven different nuclear plants under construction. The study contains relatively little documentary support, however, for the conclusions reached.

I understand that the study was based largely upon separate " case studies" of the seven plants which may contain somewhat more detailed documentation and analysis.

We have obtained copies of case studies A, B, and C, but have not been able to obtain any of the remaining case studies. Neither have we been able to obtain any of the documentation or analysis supporting the conclusions reached in the " case studies". This information would be of definite assistance to us in thoroughly and fairly evaluating the Diablo Canyon Project. Accordingly, we request that the following information be provided to us under the Freedom Of Information Act, 5 U.S.C. 5552:

a) All " case studies", or analyses of quality assurance at nuclear power plant construction projects by whatever designation, used, reviewed, or relied upon in preparing the study " Assurance of Quality In Nuclear Construction Projects",

b) All statements, comments, interview notes, minutes, transcripts or tapes used, reviewed, or relied upon in preparing either the " case studies" or the study

" Assurance of Quality In Nuclear Construction Projects".

If for any reason you are unable to promptly comply with some part of this request, please comply to the extent possible and indicate which item or items you are unable to promptly comply with. If you are unable to comply with any part of this request due to an alleged exclusion from the provisions of the Freedom Of Information Act, please identify the alleged exclusion, and the item to which the exclusion is alleged to apply. Please identify the item by providing, where applicable, its date, author, originator, general subject matter, title, present location, custodian, recipients, and the use to which it was put in preparing either the " case studies" or the study, " Assurance of Quality In Nuclear Construction Projects".
