CRITICAllTY SAFETY PROGRAM UPDATE (TAC NO. L30988)

Dear Mr. Sharkey:

This acknowledges receipt of your letter of September 30,1997, transmitting a copy of the fourth quarterly status mport of Combustion Engineering's (CE's) Criticality Safety Program Update (CSPU) covering the period from July 1 to September 30,1997.

The CSPU plan was submitted on September 20,1996, and is designed to formalize and strengthen the nuclear criticality safety program at the Hemattie, Missouri site. In that plan, CE committed to submit a progress report of the implementation of the CSPU on a quarterly basis.

We note from your September letter that the progress for this period on the CSPU is on schedule. In your Septembar 30 letter, you have proposed that the status report be submitted semiannual!y because the milestones for the remainder of the CSPU are less frequent.

Mr. Robert Freeman, of your staff, and Sean Soong of the NRC discussed your proposal during a teleconference on October 28,1997. Mr. Freeman indicated that for the remainder of the CSPU, there are less tasks within each milestone thereby reducing the amount of reporting.

Based on this information and your ability to maintain your schedule as reported in the latest CSPU status report and previous status reports, the staff agrees that, status reports may be submitted semiannually. The fifth status report should be submitted by March 31,1998.

Your cooperation in keeping us informed of the progress of the CSPU is appreciated.
