Administrative Law Judge Atomic Safety and Licensing Board Panel U.S. Nuclear Regulatory Commission Washington, DC 20555 In the Matter of GENERAL PUBLIC UTILITIES NUCLEAR (Three Mile Island Nuclear Station, Unit No.1)

Docket No. 50-289 (CH)

Dear Judge Margulies:

I am forwarding to you herewith a copy of a letter to me from Lawrence M.

Litt, M.D., concerning his advice to Mr. Raymond H. Smith , of the NRC Staff in Region I. As indicated at .the final prehearing conference, the Staff had, originally intended to call Mr. Smith- as a witness in this proceeding, but had recently learned that Mr. Smith's illness might prevent his attendance. I believe the letter addresses both the nature of Mr. Smith's illness and his inability to attend the hearing, as you re-quested. (See Record Transcript at 402).
