Bailey Point Road Wiscasset, Maine 04578 SUBJECT: NRC INTEGRATED INSPECTION REPORT 50-309/98-01 AND NOTICE OF VIOLATION

Dear Mr. Meisner:

On May 2,1998, the NRC completed an inspection at your Maine Yankee reactor facility.

The results of that inspection were discussed with you and others of your staff at an exit meeting held on May 11,1998. The enclosed report presents the results of that inspection.

During the two-month period covered by this inspection period, your conduct of activities at the Maine Yankee facilities was safety focused. The stop work order and subsequent corrective actions taken in response to workers cutting through energized electrical wires were appropriate. The evaluation and corrective actions for general worker performance and supervision issues was noted as a positive initiative. However, the appropriate oversight of contractors by Maine Yankee remains as one of the primary areas of NRC concern during the decommissioning process.

Poor implementation of the spent fuel pool foreign material exclusion (FME) program is a violation of NRC requirements. A vague procedure, poor worker training, and a lack of program oversight were noted by the NRC.

The violation is cited in the enclosed Notice of Violation, and the circumstances surrounding the violation are described in detailin the' enclosed report. Please note that you are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.
