APPEAL OF NRC DETERMINATION CONCERNING MAINE YANKEE ATOMIC POWER COMPANY CLAIM OF BACKFIT REGARDING PERMANENTLY SHUTDOWN REACTOR SECURITY PLAN

Dear Mr. Meisnes:

By letter dated March 16,1999, Maine Yankee Atomic Power Company (MYAPC) appealed a U.S. Nuclear Regulatory Comtr'?sion (NRC) staff determination that MYAPC had not raised a valid backfd claim in a July 16, W98, letter to the NRC. In accordance with Office of Nuclear Reactor Regulation (NRR) Office Letter 901, " Procedures for Managing Plant-Specific Backfits and 10 CFR 50.54(f) Information Requests," this letter acknowledges your backfit appeal. The staff has begun the process of convening a backfit review panel to evaluate your appeal.

In your letter you stated that, normally, if MYAPC were to appeal an NRC staff position, you would provide some discussion conceming the differing opinions, but that in this case, you believe the staff misunderstood what your backfit claim sought. Therefore, you reiterated a previous request that the NRC staff meet with you to clarify these misunderstandings. Based on your letter and a phone conversation with George Zinke of your staff, we believe that i

resolution of the issues at this meeting could obviate the need for the backfit appeal process.

Accordingly, we would like to schedule a_ meeting with you later this month and defer appointing a backfit review panel until after that meeting. If you believe that we should not wait and desire that we go forward with appointing the backfit review panel, please contact your Project Manager, Michael Webb at (301) 415-1347.
