EXEMPTION FROM FINANCIAL PROTECTION REQUIREMENT LIMITS OF 10 CFR 50.54(w) AND 10 CFR 140.11 (TAC NOS. MA0659 AND MA0660)
Dear Mr. Meisner:
The Commission has issued the enclosed exemption from certain requirements of 10 CFR 50.54(w) and 10 CFR 140.11 for the Maine Yankee Atomic Power Station (MYAPS). The exemption is being issued in response to your application dated January 20,1998, as supplemented by letters dated June 18 and 25,1998, in which you requested a reduction in the amount of insurance required for your facility to $50 million for onsite property damage coverage and $100 million for offsite liability coverage on the basis that the potential risk to public health and safety is substantially reduced because of the permanently shutdown and defueled status of MYAPS.
Your January 20,1998, application included references to SECY 93-127 and SECY 96-256, which considered the effects of an event that drains the water from the spent fuel pool. We noted that your application requested an exemption from financial protection requirements after a shorter spent fuel cooling period than previously established in the references you provided, in order to evaluate your request, the staff requested additional information, which resulted in additional time needed to complete our review.
The staff has completed its review of your request to reduce your insurance coverage and approves the reduction to $50 million for onsite property damage coverage and
$100 million for offsite liability coverage, as well as withdrawal from participation in the secondary liability insurance pool for offsite liability insurance.
We are also enclosing two (2) copies of Amendment No.11 to indemnity Agree-ment No. B-51. Please sign both copies and return one copy to me.
