Dear Mr. Brack:

I am responding to your e-mail of August 16,1999, to me, and to the telephone conversation we had on September 1,1999, with respect to your comments about the decommissioning of the Maine Yankee site. The concems that you raise with respect to the status of the fuel at Maine Yankee have been raised in previous letters to the U. S. Nuclear Regulatory Commission. As Mr. Zwolinski of NRC's Office of Nuclear Reactor Regulation explained in his letter of August 19, 1999 to you, we have re-examined these concems, and continue to conclude that the licensee's -

programs as required by the NRC are sufficiently comprehensive to provide an adequate assessment of the radiologicalimpact of operations on the offsite environment. Nonetheless, we will continue to consider these issues with regard to the fuel failures at Maine Yankee as the d-ommissioning progresses. Also, as we discussed on September 1, you have been in cornact with representatives of Bamwell, South Carolina, and the State of South Carolina,

conceming your questions regarding the status of the Bamwell facility.

With respect to your concems about the radiological surveys to be done to support license termination and compliance with NRC release criteria, the licensee has not yet submitted a license termination plan for NRC review. The required radiological surveys and sensitivity will be part of that document and subject to NRC review at that time.
