I NOTICE OF VIOLATION Maine Yankee Atomic Power Company Wiscasset, Maine 04578 Docket No. 50-309 License No. DPR-36 During an inspection conducted between March 8,1998 and May 2,1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and 4 Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

A. Maine Yankee technical specifications section 5.5.1.a, requires written procedures applicable to the safe storage of irradiated fuel as recommended in Regulatory Guide

1.33, Revision 2, Appendix A, February 1978. Regulatory Guide 1.33, Appendix A, section 9e, requires general procedures for the control of maintenance. Maine Yankee procedure 26-309, Fuel Foreign Material Exclusion (FME) Manual, Revision 3, section 6.3.1.a, required that workers log items entering and leaving the FME zone.

Contrary to the above, on April 13,1998, items associated with a scaffolding project (pins, tie wraps, wood toe boards, and orange safety net) were inside the FME zone I and not logged as required by procedure.

Pursuant to the provisions of 10 CFR 2.201, Maine Yankee Atomic Power Company is hereby required to submit a written statement of explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Chief, Low Level Waste and Decommissioning Projects Branch, NMSS, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clear 1y marked as a " Reply to Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

Your response may reference or include previously docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in the Notice, an order or a Demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.

If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.
