NOTICE OF VIOLATION Consumers Power Company Docket No. 50-155 As a result of the inspection conducted on December 8-12, 1986, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1985), the following violation was identified:

10 CFR 50.54(t) requires that nuclear power reactor licensees review their emergency preparedness program at least every 12 months. The part of the review involving the evaluation for adequacy of interface with state and local governments shall be made available to the appropriate state and local governments. The results of the review, along with recommendations for improvements, shall be documented, reported to the licensee's corporate and plant management, and retained for a period of five years.

Contrary to the above, the licensee did not make available to state and local governments that portion of the annual review of the adequacy of the interface with state and local governments. In addition, documentation of this portion of the review was unavailable; and therefore it could not be reported to the licensee's corporate and plant management, and retained for a period of five years.

This is a Severity Level IV violation (Supplement VIII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
