In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actiora,' NUREG 1600, the violation is listed below: ,

Mr. Raymond J. Flowers, while performing licensed duties, shall observe the operating prncedures and other conditions specified in the facility license which atthorizes operation of the facility.

Technical Specification 6.11 requires, in part, that procedures for personnel radiation protection shall be prepared consistent with the requirements of 10 CFR, Part 20, and shall be approved, maintained and adhered to for all operations involving personnel radiation exposure. '

Administrative Procedure 5.8, "High Radiation Area Key and Access Control,"

Revision 10, Step 5.1.f.7, requires, in part, that a high radiation area shall be exited when a personnel dosimetry problem is encountered (e.g., Electric Dosimetry Entry Dose Level Alarm or Electronic Dosimetry Dose Rate Alarm).

Contrary to the above, on February 2,1997, Mr. Raymond J. Flowers, an employee of Consumers Power Company, did not exit 3 high radiation area after receiving an alarm on his electronic dosimeter as required by Administrative Procedure 5.8, a procedure for personnel radiation protection. Failure to adhere to this procedure is a violation of Technical Specification 6.11.

This is a Severity LovelIV violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, Mr. Raymond J. Flowers (Licensee) is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Regional Administrator, Region 111, 801 Warrenville Road, Lisle, Illinols,60532, and marked "Open by Addressee Only" and a copy to the NRC Resident inspector at the Big Rock Point Nuclear Plant, with a similar marking within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply shoulo be clearly marked as a " Reply to a Notice of Violation" and should include: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that wili be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notics, in order or a Demand for Information may bo issued as to why the license should nt be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending the response time.

Under the authority of Section 182 of the Act,42 U.S.C. 2232, this response shall be submitted under oath or affirmation.
