l NOTICE OF VIOLATION l

l Consumers Energy Docket No. 50-155 l

Big Rock Point Nuclear Plant License No. DPR-6 l

l During an NRC inspection conducted from April 30,1997, through June 16,1997, two violations of NRC requirements were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violations are listed below:

Big Rock Point Technical Specification (TS) 6.8.1 requires that written procedures be established, implemented, and maintained for all structures, systems, l

components, and safety actions defined in the Big Rock Point Quality List. These l

procedures shall meet or exceed the requirements of ANSI N18.7, as endorsed by CPC-2A, " Quality Program Description for Operational Nuclear Power Plants."

Section 5.2 of CPC-2A states,in part, that system operating procedures and testing procedures are used to control activities affecting the quality of safety related structures, systems, and components.

Test Procedure TV-07 " Control Rod Drive (CRD) Scram Test from Notch "23" and l

Coupling Integrity Checks," Revision 20, Step S.2.h requires that when the CRD insertion speed is outside the range of 26 to 28 seconds that the Rate Set Valve, V-1 be adjusted as required to improve drive performance, and the CRD be re-timed.

l Contiary to the above, the inspector identified that on April 3,1996 and May 2, i

1997, seven and five CRDs respectively were left after insertion time testing with insert speeds greater than 28 seconds.

This is a Severity Level IV violation (Supplement 1).

10 CFR 50, Appendix B, Criterion V, " Instructions, Procedures, and Drawings,"

states, in part, that activities affecting quality shall be accomplished in accordance with these instructions, procedures, and drawings.

Systern Operating Procedure (SOP)-10 " Containment Vessel," Revision 146, Step 2,2.c states, "Both doors of the equipment lock shall be closed at all times except for ingress, egress or to break containment integrity."

Contrary to the above, the licensee identified on May 31,1997, at 8:30 a.m., that the containment equipment lock inner door was open, an activity affecting quality, without ingress, egress, or breaking containment integrity evolutions in progress.

This is a Severity Level IV violation (Supplement 1).

submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Pianhington, D.C. 20555, with a copy to the Regional

Administrator, Region ill, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further i

violations, and (4) the date when full compliance will be achieved. Your response rnay l

reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration wi!! ba given to extending the response time.

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction. However, if you find it necessary to include such information, you should clearly indicate the specific information that you desire not to be placed in the PDR, and provide the legal basis to support your request for withholding the information from the public.
