NOTICE OF VIOLATION Consumers Power Company Docket No.

50-155 Big Rock Point Nuclear Plant License No. OPR-6 During an NRC inspection conducted from October 20 through December 14, 1993, a violation of NRC requirements was identified.

In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1993), the violation is described below:

1 10 CFR Part 50, Appendix B, Criterion XI, requires, in part, that measures be established to ensure that all testing required to demonstrate that s

structures, systems, and components will perform satisfactorily in service is identified and performed in accordance with written test procedures which incorporate the requirements and acceptance limits contained in applicable design documents.

Test results shall be documented and evaluated to ensure i

that test requirements have been satisfied.

Contrary to the above, the results of static VOTES testing at the final, as-left torque switch setting for M0-7053 conducted on August 4, 1993, were not evaluated prior to the return to service of the valve on August 28, 1993, and were found to be unacceptable on November 5,1993, when the valve was stroked open and subsequently would not close.

This is a Severity Level IV violation (Supplement 1) (50-155/93019-Ol(DRP)).

l Pursuant to the provisions of 10 CFR 2.201, Consumers Power Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington D.C. 20555 with a copy to the U. S. Nuclear Regulatory Commission, Region III, 801 Warrenville Road, Lisle, Illinois 60532-4351, and a copy to the NRC Resident Inspector at the Big Rock Point facility within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or if contested, the basis i

for disputing the violation, (2) the corrective steps that have been taken and the results achieved,_ (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order or a demand for information may be issued as to why the license should not be. modified, suspended, uor revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
