(Three Mile Island Nuclear Station, Unit 2)

Docket No. 50-320 OLA, ASLBP No. 87-554-0LA

Dear Administrative Judges:

On May 9 and 16, 1988, the Licensee filed four motions for sumary disposition of the contentions of the Joint Intervenors (Susquehanna Valley Alliance and Three Mile Island Alert). During a conference call held on May lith, the NRC staff requested and was granted a one week extension, until May 23, 1988, for the filing of a motion for summary disposition. The Staff has now had the opportunity to perform a preliminary review of the Licensee's motions. Since the Licensee has moved for sumary disposition of all of the admitted conten-tions in this proceeding, the NRC staff will set forth its position on sumary disoosition in response to the Licensee's motions and will not separately move for sumary disposition. In accordance with the Atomic Safety and Licensing Board's "Memorandum (Hemorializing Conference Call)", dated May 11, 1988, the Staff's response- to the May 9th motion is due on June 20, 1988, or 15 days from the date the second round of evaporator system drawings are made avail-able for inspection, whichever is later, and the response to the May 16th motions are due on June 22, 1988.

Sincerely, j M. b Stephen H. Lewis Senior Supervisory Trial Attorney cc: Service list 8806080057 880520 PDR ADOCK 05000320 0 PDR 1so7
