REQUEST FOR DELAYING RECEIPT MEASUREMENTS AND DISTRIBUTION OF DOE /NRC FORM 741 (TAC NO. L30965) AND REVISIONS TO FUNDAMENTAL NUCLEAR MATERIAL CONTROL PLAN (TAC NOS. L30943 AND L30959)

Dear Dr. Reda:

In accordance with your correspondence dated May 1,1997, and pursuant to Part 70 to Title 10 of the Code of Federal Regulations, Materials License SNM-1097 is hereby amended to allow the delaying of receipt measurements and distribution of DOE /NRC Form 741 on specified material. Accordingly, new Safeguards License Condition SG-1.4 is being issued, effective immediately, and reads as follows:

SG-1.4 Notwithstanding the commitment, in Section 7.1 of the Fundamental Nuclear Material Control (FNMC) Plan identified in Condition SG-1.1, to perform receipt measurements and distribute DOE /NRC Form 741 within 30 days of receiving shipments of SNM, the licensee shall have 30 additional oays (from the date of material receipt) to fulfill the above stated commitment relative j

to the 12 tots of UO 2powder material identified in the attachment of its letter dated May 1,1997. This Condition shall automatically expire on h

h June 21,1997.

The deviation from Section 7.1 of your FNMC Plan was requested and approved pursuant to 10 CFR 70.34. The granting of your request was based on our determination that, in view of the specific circumstances, the additional time requested was justified and warranted.

We also revised Safeguards License Condition SG-1.1, effective immediately, to reflect our review and approval of your FNMC Plan revision submitted by your letter and enclosure dated February 6,1997, and subsequent addendum dated March 26,1997. This revised Condition also updated our previous review of your December 11,1996, submittal.

Revised Condition SG-1.1 of your Materials License SNM-1097 reads as follows:

SG-1.1 The licensee shall follow Chapters 1.0 through 9.0 of its Fundamental Nuclear Material Control Plan dated December 16,1987, which has been partially revised as indicated by Revision 32 of page 1 (dated December 11, 1996, and titled " Revisions by Page") and Revision 33 of page 1 (dated February 6,1997, and titled " Revisions by Chapter") of said Plan. This Plan may be further revised in accordance with, and pursuant to, the provisions 110090

of either 10 CFR 70.32(c) or 70.34.

We agree with your determination that the enclosures to your letters contain information of the type specified in 10 CFR 2.790(d) which is deemed to be commercial or financial within the meaning of 10 CFR 9.17(a)(4). Accordingly, said enclosures will be withheld from public disclosure unless subject to the provisions of 10 CFR 9.23.
