1 BACKGROUND l

By a letter dated May 1,1997, General Electric (GE) requested a delay of 30 days, beyond l the 30 days norrnally allowed, for completing receipt measurements (measured values of U l and U-235 quantities) and distributing related Nuclear Material Transaction Report DOE /NRC Form 741 with regard to 12 lots of UO2 powder material received from the Repubiic of Kazakstan on April 22,1997. This amendment request, which relieves GE from commitment in Section 7.1 of their FNMC Plan, was processed following the provisions of 10 CFR 70.34. I l'

in addition, by a submittal dated February 6,1997, and subsequent addendum dated March 26,1997, GE submitted various changes to their FNMC Plan covering different practices in the areas of measurements, practices in inventory taking, receipt ,

measurements for shipper-receiver difference evaluation, and recordkeeping. Thus, the  !

submitted FNMC Plan revisions qualify as changes and amendment request under 10 CFR 70.34 provisions.

DISCUSSION i The materials consist of 12 tots of UO2 powder in a total of 633 five-gallon containers.

The total quantity is about 13,950 kgs of uranium at 3.95% enrichment level. The Ulba plant in the Republic of Kazakstan shipped out the materials on January 16,1997 and GE received them on April 22,1997 after an unexpected delay of more than 3 months for customs clearance and port release. Because of the mentioned delay, the materials arrived at GE during a period of time when the personnel performing measurement functions are involved in other production activities that GE cannot reschedule or modify the planned operations. Consequently, GE could not meet the 30-day requirement specified in Section.7.1 of their FNMC Plan, which requires GE to complete all confirmatory receipt measurements and distribute DOE /NRC Form 741 within the required time frame.

Therefore, a 30-day time extension has been requested.

The licensee submitted various changes to the FNMC Plan within all nine chapters, except Chapter 2.0. All revisions are made by chapter with a new designated date and revision number. These Plan changes pertain to:

o Clarification of UF, receipts from domestic suppliers who are subject to MC&A requirements by using shipper's measurements, e Addition of function for contractor to witness sealing of UF, receipts, and exclusion of contractor audits to 74.33 licensees, e Revision to include larger containers used in the dry conversion process, e Revision to include inventory activities in non-shutdown mode for specific areas but not to lessen controls of complete inventory,

  • Addition of a section to describe the use of bar code readers to enhance the inventory performance, and to remove the use of inventory tags which provide minimum benefits and hinder the inventory process, e Revision to further describe the historical uranium weight fraction determination and shipper-receiver differences evaluation process, and e Revision to include a reference to records storage on laser disk and availability of records review from personal computer.

All of the propose.d changes had been previously discussed with the MC&A licensing reviewer, and upon review of these submitted changes, they were found to be acceptable.

The MC&A licensing staff reviewed and approved (NRC letter to GE dated May 9,1997) a previous revision of GE's FNMC Plan which was submitted under the provisions of 70.32(c) changes. For update pu.goses, this license amendment will include the revised Safeguards License Condition SG-1.1 to reflect the most current and approved version of the FNMC Plan. .

l ENVIRONMENTAL REVIEW I l

The staff has determined that the requested time extension and the submitted FNMC Plan l revisions do not adversely affect public health and safety, the common defense and .

security, or the environment and is otherwise in the public interest. The provisions in l 10 CFR 51.22(c)(12) cite an exclusion for safeguards plans and material accountability.  !

Therefore, neither an environmental assessment nor an environmental impact statement is l warranted for this action.

CONCLUSION The staff concludes that granting the licensee's time extension request for completing receipt measurements and distributing DOE /NRC Form 741 of received uranium containers is justified and warranted, and that it will not reduce the effectiveness of the licensee's safeguards program. The staff also determined that the licensee's FNMC Plan revisions contain appropriate and necessary commitments to satisfy applicable MC&A regulations specified in 10 CFR 74.31. Thus, a temporary (one-time) Safeguards License Condition SG-1.4 is being issued which allows for the limited extension of time. In addition, 6xisting Safeguards License Condition SG-1.1 is being revised to update the FNMC Plan i revisions. l The. Operations Branch (FCOB) inspection staff has no objection to this proposed action.
