SUBJECT: NRC INTEGRATED INSPECTION REPORT 50-369/97-04 and 50-370/97-04

NOTICE OF VIOLATION <

Dear Mr. Barron:

On April 5.1997, the NRC completed an inspection at your McGuire 1 & 2

reactor facilities. The enclosed report presents the results of that inspec-

tion. ,

During the 6-week period covered by this inspection aeriod, your conduct of I

activities at the McGuire facilities wo. generally claracterized by safety- '

conscious operations, sound engineering and maintenance practices, and careful

radiological work controls. Appropriate control of outage work activities ,

such as_ safe heavy load movements and heightened awareness for potential Unit +

1 impact on the safe operation of Unit 2 were noted during this period.

However, a violation of NRC requirements was identified regarding (1) a

failure to ensure that the FWST transmitter enclosure heaters were installed

in accordance with design documents, and (2) a failure to report in a timely *

manner a degraded condition on Unit 1 in accordance with 10 CFR 50.72. Both

of these issues were identified by the NRC and were associated with previous

problems. .

The violations are cited in the enclosed Notice of Violation and the

circumstances surrounding the issues are described in detail in the enclosed

report. Please note that you are required to respond to this letter and q

should follow the instructions specified in the enclosed Notice when preparing

your response. The NRC will use your response, in part, to determine whether

further enforcement action is necessary to ensure compliance with regulatory

requirements.

The enclosed Inspection Report also identifies activities that violated NRC

requirements that will not be subject to enforcement action because the

l licensee's efforts in identifying and/or correcting the violation meet the

criteria specified in Section VII.B.1 of the Enforcement Policy. These issues

involved (1) a failure to maintain adequate configuration control for a

,

reactor coolant system letdown filter housing vent which contributed to an RCS

leak in excess of Technical Specification limits: and (2) a failure to l

, complete maintenance on ice condenser components in accordance with prescribed [ t
