LICENSING BASES RECORD CHANGE - MCGUIRE NUCLEAR STATION, UNITS 1 AND 2 (TAC NOS. M98964, M98965, MA5017, AND MA5018)

Dear Mr. Barron:

On March 18,1998, a telephone conference was conducted to discuss the subject licensing bases record change regarding Duke Energy Corporation's (DEC) license amendment request dated May 27,1997, and the staff's approval in the form of Technical Specification (TS)

Amendments 184 and 166, dated September 30,1998. Your letter of March 18,1999, documented the discussions and provided the formal request for action on the proposed correction. Another letter dated March 23,1999, provided additionalinformation that was missing from the March 18,1999, letter. The correction would change the designation for TS Surveillance Requirement (SR) 3.3.5.2 from " administrative" to "more restrictive". This correction is currently required for Unit 2. which is undergoing a refueling outage, but it applies to both units.

The TS (Table 3.3-3 Functional Unit 9) applicable before the implementation of TS Amendments 184 and 166 required operability of the Loss of Power Diesel Generator Start Instrumentation only in Modes 1,2,3, and 4, with a suNeillance frequency of at least once per 18 months. TS Amendments 184 and 166 revised the applicability to also include "when associated DG [ diesel generator)is required to be OPERABLE by LCO [ limited condition of operation) 3.8.2." In

accordance with TS 3.8.2, the associated DG is required to be available in Modes 5, and 6, and 1

during movement of irradiated fuel assemblies. The change, the inclusion of Modes 5 and 6 and during movement of irradiated fuel, results in a "more restrictive" SR and effectively reduced the scheduled interval for performance of the surveillance by approximately 28 days. This results from the fact that the time period continues through an outage.

The second page is Table M - More Restrictive Changes Section 3.3 Instrumentation, which includes Change 3.3 M.30. The deleted Change 3.3 A.52 and the :nserted Change 3.3 M.30 contain the same requirement. Also, the license conditions at the end of Appendix D remain in effect.
