May 11,1999 Mr. H. B Barron Vice President, McGuire Site Duke Energy Corporation 12700 Hagers Ferry Road Huntersville, NC 28078-8985 1

SUBJECT:

MCGUIRE NUCLEAR STATION, UNITS 1 AND 2 RE: SAFETY EVALUATION OF LICENSEE'S RESPONSE TO GENERIC LETTER 96-05 (TAC NOS.

M97065 AND M97066)

Dear Mr. Barron:

i On September 18,1996, the NRC issued Generic Letter (GL) 96-05, " Periodic Verification of i

Design Basis Capability of Safety-Related Motor-Operated Valves," requesting each nuclear power plant licensee to establish a program, or to ensure the effectiveness of its current program, to verify on a periodic basis that safety-related motor operaiud valves (MOVs)

{

continue to be capable of performing their safety functions within the current licensing bases of the facility. On November 14,1996, you submitted a 60-day response to GL 96-05 notifying the l

NRC that you would implement the requested MOV periodic verification program at the McGuire i

Nuclear Station, Units 1 and 2. Also, on March 17,1997, you submitted a 180-day response to GL 96-05 providing a summary description of the MOV periodic verification program planned for implementation at McGuire. In a submittal dated March 31,1998, you updated your commitment to GL 96-05. Further, on March 19,1999, you provided a response to an NRC i

request for additional infcrmation regarding GL 96-05 dated January 28,1999.

The NRC staff has reviewed your submittals and applicable NRC inspection reports and finds your commitment to implement the Joint Owners Group (JOG) Program on MOV Periodic i

Verification tc include all three phases of that program. You should notify the NRC if your commitment does not include all three JOG program phases. Based on this understanding of your commitment with respect to GL 96-05, the NRC staff finds that you have established an acceptable program to verify periodically the design-basis capability of the safety-related MOVs at McGuire Nuclear Station, Units 1 and 2. Therefore, the NRC staff concludes that you have adequately addressed the actions requested in GL 96-05. The NRC staff may conduct inspections at the McGuire site to verify that the implementation of the MOV periodic verification program is in accordance with your commitments; this NRC safety evaluation; the NRC safety evaluation dated October 30,1997, on the JOG Program on MOV Periodic Verification; and the NRC safety evaluation dated April 14,1998, on the Westinghouse Owners Group methodology for ranking MOVs by their safety significance.
