Dear Mr. Murphy:

This replies to your October 26 letter addressed to the Docketing and Service Branch, Office of the Secretary.

As you probably know, the Commission requires, as a condition of authorizing full power operation of any nuclear power plant, that there be an offsite emergency plan in place and capable of being implemented which provides reasonable assurance that protective measures can be taken for people living out to about 10 miles.

At the present time, an Atomic Safety and Licensing Board is conducting a public hearing to determine if the New Hampshire portion of the offsite emergency plan for the Seabrook nuclear power plant meets that requirement.

Concerns such as the ones raised in your letter are among the matters being litigated. Further, Public Service Company of New Hampshire's plan for the Massachusetts portion of the offsite emergency planning zone still is in the early stages of review by the NRC staff and the Federal Emergency Management Agency.

Accordingly, I cannot predict when a decision will be made on the overall I adequacy of offsite emergency planning for the Seabrook facility. In the meantime, I am sending your letter to the NRC's Public Document Room for inclusion in the public docket file for the Seabrook proceedir.g.
