Pursuant to the Freedom of Information Act as amended (5 U.S.C. 9552), the Government Accountability Project (GAP) of the Institute for Policy Studies requests all copies of agency records as defined by 10 C.F.R. E 9.3a (b) and NRC Manual, Appendix 0211, Parts 1.A.2 and A.3 (approved Oct-ober 8, 1980) including but not limited to notes, memoranda, telephone logs, tapes, diaries, transcripts, summaries, let-ters, drafts, evaluations, minutes or notes of meetings, cal-endars, computer printouts, interview reports, agreements, s voice recordings, any other data compilations, interim or i final reports and/or status reports generated in connection with--

(1) any and/or all Non-Conformance Reports (NCR) supplied

to or currently in the possession of the Region III Nuclear Regulatory Commission or the Nuclear Regula-

) tory Commission's Office of Inspections and Enforcement i ment generated at the William H. Zimmer nuclear station l under construction near Cincinnati, Ohio;

, (2) In addition to the above, any and/or all non-conform-l ance reports and/or any other documents or records as defined (above) that the Nuclear Regulatory Commission

Region III or the Nuclear Regulatory Commission Office i of Inspections and Enforcement plans to return to i'

the Cincinnati Gas & Electric Company (licensee) or any contractor, sub-contractor, co-partner, co-mana-ger or other entity that has an interest in the Zim-mer plant, including, but not liriited to, the Kaiser Corporation, the Bechtel Corporation, Sargent & Lundy, Dayton Power & Light Co. and/or Columbus & Southern Ohio Electric.

If any records have been destroyed and/or removed, please provide all surrounding records, including but not limited to a list of all records which have been or are destroyed or returned to licensee, and/or removed, a de-scription of the actions taken, relevant date(s), individ-ual, office or agency-wide policies and/or justifications for the actions, identification of all personnel involved 8501280069 840312 PDR FOIA CARPENT84-176 PDR

GAP requests that fees be waived because " finding the information can be considered as primarily benefitting the public" (5 U.S.C.8552(a)(4)(a) . GAP is a non-profit, non-partisan public interest organization concerned with honest and open government. GAP requests the above information as part of an on-going monitoring aroject on the adequacy of the NRC's efforts to protect public health and safety at the Zimmer project.

For any documents or portions of documents that you deny due to a specific FOIA exemption, please provide an index itemizing and describing the documents or portions of documents withheld. The index should provide a detail-ed justification for your grounds for claiming each exempt-ion, explaining why each exemption is relevant to the docu-ment or portion of document withheld.
