Dear Mr. Felton:

This is a request made under the federal Freedom of Information Act, U.S.C. 552.

Please send me a copy of the draft or final report (whichever is completed) of administrative lav judge Helen Hoyt's investigation on the Zimmer nuclear power plant in Cincinnati.

As you know, the FOI Act provides that if portions of a document are .

exempt from release, the retainder must be segregated and disclosed. Therefore, I I will expect you to send me all non-exempt portions of the record which 1

. have requested, and ask that you justify any deletions by reference to specific exemptions of the FOI Act. I reserve the right to apieal your decision to withhold any materials.

I am prepared to pay reasonable duplication fees in connection with this request. However, the FOI Act provides for vaiver or reduction of fees if disclosure could be considered as"primarily benefiting the general public."

I am a producer employed by the CBS Evening News, and intend to use the information I am requesting as research material for a story on the Zimmer nuclear power plant. Therefore I ask that you vaive all search and duplication fees, Since this information vill be used in an upcoming story for the CBS Evening News, I would appreciate your communicating with me by telephone, rather than by nail, if you have any questions regarding this request.
