MOTION OF THE SEA.CGAST AtLTI-PO_hTATION LEAGUF TO JOIN IN APPEAL OF Tl?E OFFICE Of TIIE CollSUMER ADVOCATE NOW COMES the Seacoast Anti-Pollution League (S APL) and respectfully moves to be allowed to join in the appeal filed by the Consumer Advocate, Michael W. Holmes, which appeal was filed on March 27, 199.'. pursuant to Supreme Court Rule 10. In support ,

of this motion, SAPL states as follows:

1. SAPu is a New .5fampshire based citizen organization which has frequently participated as a full party in proceedings before the New llampshire Public Utilities Commission, the Nuclear Decommissioning Finance Committee, and this Court. SaPL has always been concerned about matters pertaining to the licensing of, rinancing for, and rate increases claisaed to be necessary to suppoi-t the construction of and operation of the Seabrook nuclear power plant. SAPL participated in proceedings before the Nuclear l Decommissioning Finance Commictee through one of its board members, Mary K. Metcalf, and took positions before the l Committee, including, 1Dter alia, a position consistent with that of the Consumer Advocate in this appeal.

2. This appeal raises the question of whether or not there was substantial evidencu on which the committee could find, as it did, that ;he useful life of the Seabrook nuclear plant would be its licente life, i.e., 40 years from the time the full power license was issued, in October of 1986. SAPL has substantial knowledge concerning the historic record of the useful life of nuclear plants in the United States, and the fact that no commercial nuclear plant was ever operated commerclally for more than 31 years.2 SAPL has previously presented avidence that l Seabrook's main owner, PSNH, has itself estimated plant life at 30 years, and that the PUC has previously found a likely life of 35 years.
3. The participation of SAPL in this proceeding will not unduly burden proceedings before the Court, nor oroaden the issues presented. Since SAPL intends to brief and argue only the issue raised by the-consumer Advocate.
4. The # ntervenor respondent, New Hampshire Yankee, has indicated it has no objection to the granting of this motion.
