MINUTES OF INTERNAL MEETING OF THE DAVIS-BESSE OVERSIGHT PANEL The implementation of the IMC 0350 process for the Davis-Besse Nuclear Power Station was announced on April 29, 2002. An internal panel meeting was held on March 2, 2004. Attached for your information are the minutes from the internal meeting of the Davis-Besse Oversight Panel, and the Open Action Item Checklist.

MEETING MINUTES: Internal IMC 0350 Oversight Panel Meeting Davis-Besse Nuclear Power Station DATE: March 2, 2004 TIME: 12:30 p.m. Central ATTENDEES:

1. Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.
2. Communication Status C. Lipa led a discussion of communication status. J. Strasma stated that RIII PAO completed reading all letters and emails submitted to the Agency by members of the public. There were 2-3 pieces of correspondence turned over to the RIII Allegation staff for review. J. Strasma stated there were no safety concerns that needed to be addressed prior to restart, however potential concerns were turned over to the technical staff for additional review.

J. Strasma stated that J. Caldwell has agreed to make himself available via conference call for members of the news media when and if the restart approval letter is signed and issued. J. Strasma stated that the Chairman is aware of this conference call and agrees with the approach.

C. Lipa mentioned that the inspection results memos for Restart Checklist Items 2.e.

and 4.b. have been released publicly.

J. Strasma mentioned he got a call from FOIA people regarding FirstEnergy release of condition reports.

D. Passehl discussed the draft reply to Ohio Citizens Action regarding the groups recent letters.

C. Lipa reiterated that the Panel needs to review incoming correspondence from external sources for potential allegations. C. Lipa mentioned an example when this review was missed for at least one piece of correspondence. A. Mendiola mentioned that Headquarters staff would go back and review if anything was missed.

A. Mendiola led a discussion of several pieces of recent correspondence for Panel review for potential allegations.

C. Lipa stated that the final significance determination letter for the HPI issue is being routed for final review. B. Ruland suggested that the communication of the issue be factored into the Restart Communication Plan.

3. Plant Status and Inspector Insights and Emergent Issues List C. Thomas presented plant status and insights. C. Thomas went on a final containment closeout tour. The licensee is continuing to work on resolving a vibration problem with the control rod drive mechanism motor-generator set. J. Jacobson discussed with the licensee a request to supply the NRC with information to clarify activities the licensee had already taken regarding potential corrective action team inspection issues. B.

Ruland expressed several comments on this issue.

K. Riemer updated the Panel on the status of recent EP issues. The Panel concluded that all EP issues have been satisfactorily resolved to support plant restart.

4. New/Potential Licensing Issues A. Mendiola stated there are no licensing issues precluding restart of the plant.

A. Mendiola discussed status of outstanding Green Ticket issues.

5. Allegations: 1) New; 2) Determine if Required to Be Resolved Prior to Restart; and
3) Requested Extensions D. Passehl led a discussion on allegations. There are no new allegations required to be resolved prior to restart.
6. Draft February Input to Congress D. Passehl led a discussion of draft February Input to Congress. D. Passehl will incorporate comments and resend the report to the Panel.
7. Making the Inspection Results Memorandums Publicly Available as Stand Alone Documents in ADAMS at Restart C. Lipa led a discussion of making the inspection results memorandums publicly available as stand alone documents in ADAMS at restart. B. Ruland recommended drafting a letter attaching the inspection results memos and placing the document and its attachments in ADAMS. The Panel agreed with B. Rulands recommendations.
8. Panel Review Process Plan R. Baker led a discussion of the Panel Process Plan. The Panel presented a number of comments which R. Baker took action to incorporate. B. Ruland commented that the Panel needs to understand exit criteria for 0350 Panel termination. R. Baker took action to review Section B.8 of the MC 0350 and incorporate into the Panel Process Plan as appropriate.
9. Punchlist R. Baker led a discussion of the punch list. The Panel presented a number of comments which R. Baker took action to incorporate.
10. Action Items Action Item 252- (Closed) - Need to document when we have completed reading all the 1000s of letters from OCA (2/27)

J. Strasma and his staff completed reading of all letters from OCA. The Panel closed this item.
