BROWNS FERRY NUCLEAR PLANT, UNITS 1, 2 AND 3 REVISED SCHEDULE FOR REVIEW OF EXTENDED POWER UPRATE LICENSE AMENDMENT REQUESTS (TAC NOS. MC3812, MC3743, AND MC3744)

Dear Mr. Singer:

The purpose of this letter is inform you of the changes to the schedule for the Browns Ferry Nuclear Plant (BFN), Units 1, 2, and 3, extended power uprate (EPU) amendment requests and to emphasize the need for complete and timely supplements to the amendment requests to ensure completion of the staff activities by May 2007.

On June 25 and 28, 2004, Tennessee Valley Authority (TVA), the licensee, submitted amendment requests for BFN, Units 1, 2, and 3. The proposed amendments would change the BFN operating licenses to increase the maximum authorized power level by approximately 20 percent above the current maximum authorized power level for Unit 1 and approximately 15 percent for Units 2 and 3. In two letters dated October 3, 2005, the U.S. Nuclear Regulatory Commission (NRC) staff described areas where additional information was needed. TVA responded in two letters dated December 19, 2005.

As discussed in letters accepting the EPU applications for review dated May 27, 2005, the NRC staff had committed to complete the review of both EPU applications by the need date of Spring 2007 for Units 1 and 2. Based on the proposed delay in responding to the request for additional information described in your two December 19, 2005 letters, the NRC staff issued letters on January 19, 2006, stating that the schedule for completion of the review may be extended, and the NRC staff may not complete its review by the need date of Spring 2007.

On February 13, 2006, a telephone conference was held to discuss the schedule and information needed to complete the reviews. During the telephone conference TVA discussed their planned approach for addressing NRC staff questions and the schedule for providing written responses. After assessing the information provided by TVA, the NRC staff will meet the original completion schedule of May 2007, if all supplements to the EPU amendment requests are provided by the dates discussed during the February 13, 2006, telephone conference (see enclosure) and are good quality.

If all supplements to the amendment request are received by the dates in the enclosure and are good quality the NRC staff plans to complete a draft SE with no open issues by October 2006

K. Singer March 1, 2006 to support the first of two planned subcommittee briefings with the Advisory Committee on Reactor Safeguards (ACRS) in November 2006. The NRC staff has tentatively scheduled a December 2006 full ACRS committee briefing.

Provided any additional supplements are submitted by May 15, 2006, and are of good quality, the review of EPU amendments can be completed by your need date.
