Dear Mr. OBrien:

This responds to your letter to Mr. Paul Lohaus of January 5, 2005, requesting certain documents to be used in connection with the State of Vermonts presentation to the Advisory Committee on Reactor Safeguards (ACRS) relative to the proposed extended power uprate application for the Vermont Yankee Nuclear Power Station (Vermont Yankee). Specifically, you identified eleven documents, and indicated that you have been unable to locate these documents on the Agencywide Document Access and Management System (ADAMS).

Please find enclosed the documents you requested. As you may know, on October 25, 2004, the agency temporarily suspended public access to ADAMS, in order to enable the NRC staff to review all documents, including those related to Vermont Yankee, and remove sensitive unclassified information. In connection with this review, in a November 17, 2004, letter to the administrative judges and the parties to the ongoing Vermont Yankee extended power uprate adjudication, counsel for the NRC staff indicated that a request for access to a specific document that is not otherwise available through the Electronic Hearing Docket, the Public Document Room, or ADAMS should be made to staff counsel. Please contact me should you have other document requests in connection with the Vermont Yankee extended power uprate matter.
