NRC STAFF DECLARATION OF POSITION In its November 17, 2006 Initial Scheduling Order at 9, the Atomic Safety and Licensing requested that the NRC Staff (Staff) provide a brief declaration as to whether it supports the Intervenor(s) or the Applicant on each of the admitted contentions. The Staff now declares that, for reasons that will be set forth in the Staffs initial and rebuttal statements of position, it will submit that NECs three contentions (concerning metal fatigue, the steam dryer, and flow-accelerated corrosion) challenging Entergys application for renewal of Vermont Yankees operating license cannot be sustained.

Respectfully submitted,
