Dear Administrative Judges:

On December 21, 2005, the Atomic Safety and Licensing Board issued its "Memorandum and Order (Ruling on Deliberative Process Privilege Claims)" ("Order"),

concerning the State of Vermont Department of Public Service's ("DPS") two Motions to Compel Production of Certain NRC Staff ("Staff") Documents, filed on August 31, 2005, and September 29, 2005, respectively. In the Order, the Board directed the Staff to resubmit its deliberative process privilege logs filed between September 6, 2005, and December 21, 2005, under procedures outlined by the Board, including "the name and job title of the most senior person who made the decision to withhold the document and assert the [deliberative process]

privilege." In accordance with the Board's Order, the Staff submits the enclosed documents concerning its claim of the deliberative process privilege for the documents at issue.

AFFIDAVIT OF CATHERINE HANEY I, Catherine Haney, being first duly sworn, do hereby state as follows:

1. I am employed as the Director of the Division of Operating Reactor Licensing

("DORL") in the Nuclear Regulatory Commission's ("NRC") Office of Nuclear Reactor Regulation ("NRR"). My supervisory responsibilities include oversight of the NRC Staff's review and evaluation of the Vermont Yankee Nuclear Power Station Extended Power Uprate ("EPU")

license amendment application.

2. During the course of its review and evaluation of the EPU license amendment application, the NRC Staff has generated or used documents that Staff members under my supervision have identified as privileged because the documents contained predecisional information related to the Staff's deliberative process. Although the identity of those documents has been disclosed during a document review process conducted as part of this proceeding, the documents themselves have been withheld in accordance with 10 C.F.R. § 2.390(a)(5) and NRC Management Directive 3.4.
3. I am aware that the Atomic Safety and Licensing Board ("Board") ordered the Staff to resubmit privilege logs that it had filed between September 6, 2005, and December 21,

2 2005, including the name and job title of a senior individual who has decided to withhold documents identified in those logs.

4. The total number of privileged documents identified in the privilege logs filed from September 6, 2005, to December 21, 2005, is 141. Of those, 40 have previously been reviewed and withheld by myself or my predecessor, Ledyard B. Marsh. Further, those 101 documents had previously been reviewed by another person within NRR with less senior responsibilities. Thus, the Board's December 21, 2005, Order applies to a total of 101 documents.
5. I have personally reviewed each of the 101 documents in question, and have determined, in accordance with the guidance contained in Management Directive 3.4, that they contain predecisional information concerning the Staff's review of the EPU application. All of the documents contain the Staff's analyses, recommendations, opinions, or evaluations, and may not necessarily reflect the final agency position with respect to the matters discussed therein. Each of the documents comprises part of the deliberative process necessary to the Staff's review of the pending EPU application.
6. Further, I have determined that disclosure of the 101 documents could result in harm to the agency, in that it would (a) prematurely disclose the preliminary views of individual Staff members and/or the Staff prior to reaching a final agency decision, and could thus create confusion as to the actual policy or views of the NRC Staff; (b) hinder the efficiency of the Staff, in that forced disclose of their internal discussions on an unresolved issue would serve to chill all future deliberations and would interfere with our ability to engage in a free exchange of opinions and analyses prior to publishing our final review documents; and (c) imply or suggest incorrectly that the opinions of the Staff members involved in these communications are actually the final decisions of the agency, while no such final decision has yet been made.
7. Accordingly, I formally invoke the deliberative process privilege with respect to

each of the 101 documents affected by the Board's December 21, 2005, Order.
