Dear Mr. Silberg:

In the Protective Order Governing Non-Disclosure of Proprietary Information issued on March 1, 2005, in the captioned proceeding, the Licensing Board stated (at 4 n.7):

This order, and the good faith representation and designation of documents as Proprietary Documents by counsel for Entergy, serves in lieu of the requirement for marking and for an affidavit under 10 C.F.R. § 2.390(b) and allows the Staff to receive Proprietary Documents and to protect their confidentiality under [the Freedom of Information Act]. However, the Staff is not obligated to participate in this order or to obtain Proprietary Documents hereunder. The Staff may instead access the documents under the compromise position approach specified in the Staff Answer at 5,[1] or in any other way that Entergy and the Staff agree is appropriate.

We have reviewed Entergys Proprietary Privileged Document Log2 and have identified several documents relating to NEC Contentions 3 and 4 that we would like to access pursuant to the compromise position set forth in the Staff Answer, at 5. Specifically, the Staff requests Jay E. Silberg, Esq.

that the documents listed in the attachment to this letter be provided to Staff counsel pursuant to the procedures of 10 C.F.R. § 2.390.
