DATED APRIL 27,2011, REGARDING POTENTIAL SUBMITTAL OF A LICENSE AMENDMENT REQUEST TO REVISE TECHNICAL SPECIFICATION 3.7.4, "ATMOSPHERIC DUMP VALVES (ADVS)" (TAC NOS. ME5233, ME5234, AND ME5235)

Dear Mr. Edington:

On March 29, 2011, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Arizona Public Service Company (the licensee) at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland.

The purpose of the meeting was to discuss the potential submittal of a license amendment request (LAR) to revise Technical Specification (TS) 3.7.4, "Atmospheric Dump Valves (ADVs)." The meeting summary was issued on April 27, 2011, and is available in the Agencywide Documents Access and Management System (ADAMS) under Accession No. ML110890816.

In the meeting summary, the NRC staff incorrectly described the licensee's proposed LAR as requiring "four ADV lines per steam generator to be operable." Instead, the proposed LAR would require "four ADV lines to be operable." Enclosed is the corrected page 1 of the meeting summary. The location of the correction is identified by the revision bar on the right.

The licensee presented information (Agencywide Documents Access and Management System (ADAMS) Accession No. ML110880244) on its proposed LAR to modify TS 3.7.4, "Atmospheric Dump Valves (ADVs)." The presentation was intended to build upon the presentation that was given in the meeting on November 18,2010, a summary of which is available at ADAMS Accession No. ML103090018.

The licensee presented an overview of the revised LAR. In contrast to the LAR that was withdrawn in December 2010, the revised LAR would require four ADV lines to be operable and would no longer include a 72-hour completion time for one of the conditions.

The licensee also addressed the four questions included in the NRC staff's letter dated December 21,2010 (ADAMS Accession No. ML103440282), acknowledging the licensee's withdrawal of the LAR dated August 25,2010. The NRC staff did not identify any immediate concerns with the licensee's responses to the questions that were presented in the December 2010 letter, but noted that concerns or questions may arise once the licensee has submitted the revised LAR. The NRC staff questioned the proposed completion time of 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> for the loss of all four ADVs. The NRC staff was concerned about having a loss of safety function for 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> and encouraged the licensee to provide additional information to support this request. The NRC staff and the licensee discussed different interpretations of the related Standard Technical Specification (STS) for Combustion Engineering plants, 3.7.4, "Atmospheric Dump Valves." The licensee interprets the STS to allow continued operation for 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> with all four ADVs inoperable, but the staff observed that a different interpretation could be drawn. The staff stated that STS are guidance and that they do not apply to a plant unless the plant can justify the basis for the applicability of that particular STS.
