- December 31, 2012 Perry operated safely Two substantive cross

-cutting issues were closed in August 2012 Annual Assessment The NRC conducted a supplemental 95002 inspection of radiation protection The NRC decided to keep Perry in Column 3 8 2012 Supplemental 95002 Inspection Inspection focus was occupational radiation safety There were no issues with public radiation safety 9

2012 Supplemental 95002 Inspection The objectives of the inspection were to provide assurance that:

-the causes of the events were understood

-the extent of the issues were identified

-corrective actions would prevent repetition

-safety culture was evaluated 10 2012 Supplemental 95002 Inspection Results Perry's corrective actions had weaknesses Consequently, the NRC could not complete its review of the extent of the issues 11 Deviation from the ROP (2013)

Deviation -Keep Perry in Column 3; not move it to Column 4 Basis -Perry operated safely

-Other NRC inspections indicated that performance issues were limited to radiation protection Conditional

-Continued acceptable performance

-Successful supplemental 95002 inspection 12 NRC Actions In 2013 Additional NRC inspectors are at Perry during the current refueling outage A continuation of the supplemental 95002 inspection is planned for June 2013 The inspection will assess Perry's actions to address the previous corrective action weaknesses and assess the extent of issues 13 14 FENOC's Response and Remarks FirstEnergy Nuclear Operating Company
