==Dear Mr. OConnor:==
On December 31, 2008, U.S. Nuclear Regulatory Commission (NRC) issued an inspection report (see ADAMS ML083660296) pertaining to the preoperational testing of an Independent Spent Fuel Storage Installation (ISFSI) at the Monticello Nuclear Generating Plant. After discussions with your staff and further review of the report we determined that information in Paragraphs 5 and 14 in the Structural Modifications and Associated Design Documentation section should be revised as described below.

ERRATA TO MONTICELLO NUCLEAR GENERATING PLANT - NRC INSPECTION REPORT 072-00058/2008-003(DNMS)

Dear Mr. OConnor:

On December 31, 2008, U.S. Nuclear Regulatory Commission (NRC) issued an inspection report (see ADAMS ML083660296) pertaining to the preoperational testing of an Independent Spent Fuel Storage Installation (ISFSI) at the Monticello Nuclear Generating Plant. After discussions with your staff and further review of the report we determined that information in Paragraphs 5 and 14 in the Structural Modifications and Associated Design Documentation section should be revised as described below.

The following information in Paragraphs 5 and 14:

The licensee was required by Title 10 Code of Federal Regulations (CFR) 72.92(a) to identify the natural phenomena that could occur in the region and to assess their potential effects on the safe operation of the ISFSI or Monitored Retrievable Storage Installation (MRS). The important natural phenomena that affect the ISFSI or MRS design must be identified. According to the Monticello Updated Safety Analysis Report, Section 2.3.5, tornadoes were a natural phenomena that could occur at the Monticello site, and Title 10 CFR Part 72.92(a), Design Bases External Natural Events, requires, in part, that natural phenomena that may exist or that can occur in the region of a proposed site must be identified and assessed according to their potential on the safe operation of the ISFSI.

should both be revised to:

The licensee was required by Title 10 Code of Federal Regulations (CFR) 72.212(b)(3) to review the safety analysis report and the related safety evaluation report, prior to use of the general license, to determine whether or not the reactor site parameters, including analyses of earthquake intensity and tornado missiles, are enveloped by the cask design bases considered in these reports. The results of this review must be documented in the evaluation made in paragraph (b)(2) of this section. In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). The NRCs document system is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.

We apologize for any inconvenience to you and your staff. If you have questions please contact Sarah Bakhsh of my staff at (630) 829-9816.

Sincerely,

/RA/
