NOTIFICATION OF CHANGE IN REVIEW SCHEDULE - Oyster Creek License Transfer Application (L-2018-LLM-0002)

Date: Wednesday, April 17, 2019 4:37:00 PM Mr. Helker:

By letter dated August 31, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18243A489), Exelon Generation Company, LLC (Exelon),

Oyster Creek Environmental Protection, LLC (OCEP) and Holtec Decommissioning International, LLC (HDI) (the Applicants) submitted an Application for Order Approving Direct Transfer of Renewed Facility Operating License and General License and Proposed Conforming License Amendment for Oyster Creek Nuclear Generating Station (Oyster Creek) and the Oyster Creek Independent Spent Fuel Storage Installation.

On September 27, 2018 (ADAMS Accession No. ML18270A021), you were provided the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this license transfer application and conforming amendment requests. In this correspondence, you were informed that the NRC metric is to complete 90-percent of all operating reactor licensing actions within 1 year and 100-percent of all operating reactor licensing actions within 2 years; the NRC acknowledged that the ... Applicants have requested that the NRC complete this proposed license transfer application by May 1, 2019; and that the NRC staff will endeavor to complete this review on the Applicants requested schedule.

Also, in the September 27, 2018 correspondence, NRC informed Exelon that [i]f there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager. The NRC believes that we have met this commitment to communicate with Exelon per the interactions on March 19, 2019 at the monthly project status call in which it was communicated that the financial safety evaluation input was delayed and that the review schedule may be impacted, as well as other numerous subsequent emails and NRC project manager conversations with you from March 12 through April 16, 2019 regarding the risk to the review schedule due to the delay in the safety evaluation input from the NRCs financial review branch and the possible delays due to the fact there are three hearing requests that are still in the process of being dispositioned. As communicated separately to you and later to Exelon senior management on the monthly status call yesterday, April 16, 2019, the revised schedule for completion of this review is August 15, 2019. The schedule change is based on the NRC staffs reevaluation of the schedule due to this delay and the schedule could change due to hearing-related activities.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this email will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of ADAMS. ADAMS is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html.
